【摘要】：當代經(jīng)濟被稱為金融經(jīng)濟,它是以流動性和效率性為核心的經(jīng)濟,財產(chǎn)權利中的行為性權利在某種意義上比歸屬性權利更重要,是保障財產(chǎn)價值增加或損失減少的核心權利。但是,在我國目前財產(chǎn)凍結的法規(guī)中,并沒有區(qū)分金融性財產(chǎn)和消費性財產(chǎn),將財產(chǎn)的價值性權利與行為性權利一并凍結。雖然在近期的規(guī)定中對此有所考慮,但還沒有將其作為原理性問題進行統(tǒng)一規(guī)定。[1]這不僅侵犯了當事人的財產(chǎn)權益,同時給其帶來了潛在的財產(chǎn)損失,甚至出現(xiàn)了導致許多企業(yè)破產(chǎn)、引發(fā)群體性事件等不良社會效果的現(xiàn)象。因此,在當代社會必須充分認識到財產(chǎn)的行為性權利,在行政機關、監(jiān)管機關、司法機關和財產(chǎn)權利人之間合理分配凍結權益,以實現(xiàn)社會綜合效果的最優(yōu)化。
[Abstract]:The contemporary economy is called financial economy, which is based on mobility and efficiency. The behavioral right in property right is more important than attribute right in a sense, and it is the core right to guarantee the increase or loss of property value. However, there is no distinction between financial property and consumer property in the current law of property freezing in our country, and the value right of property is frozen together with the right of behavior. Although this has been taken into account in recent provisions, it has not yet been uniformly regulated as a matter of principle. [1] this not only infringes upon the property interests of the parties, but also results in potential property losses, Even led to bankruptcy of many enterprises, leading to mass events and other adverse social effects. Therefore, in the contemporary society, we must fully recognize the behavioral rights of property, distribute the frozen rights and interests between the administrative organs, the supervisory organs, the judicial organs and the owners of property rights reasonably, in order to realize the optimization of the comprehensive effect of the society.
