【摘要】：在"互聯(lián)網(wǎng)+"時(shí)代,銀行的經(jīng)營模式和客戶開發(fā)模式創(chuàng)新勢在必行,與傳統(tǒng)金融體系的裂變和與新的金融生態(tài)的磨合時(shí)刻都在發(fā)生,其間的法律問題也不斷凸顯。本期兩位作者分別對直銷銀行的基本法律地位和互聯(lián)網(wǎng)銀行綁定服務(wù)的法律問題進(jìn)行了深入探討。在《作為獨(dú)立銀行主體的直銷銀行》一文中,高芮提出,應(yīng)當(dāng)盡快出臺關(guān)于直銷銀行的專門監(jiān)管法規(guī),對直銷銀行進(jìn)行明確的概念界定,將其與網(wǎng)上銀行、電子銀行區(qū)別開來作為一種獨(dú)立的銀行模式進(jìn)行專業(yè)的監(jiān)管。在本刊第98頁的《互聯(lián)網(wǎng)銀行"綁定"交易模式的法律問題》一文中,張彬發(fā)現(xiàn),以"綁定"為特征的商業(yè)模式已經(jīng)席卷了中國金融業(yè),但技術(shù)帶來的交易模式變革,也注定帶來法律風(fēng)險(xiǎn)的增長,必須做出妥善的應(yīng)對。
[Abstract]:In the era of "Internet", it is imperative to innovate the management mode and customer development mode of banks. The fission with the traditional financial system and the running-in with the new financial ecology are taking place all the time, and the legal problems between them are also becoming more and more prominent. In this issue, the author probes into the basic legal status of direct selling banks and the legal issues of Internet banking binding services. In the article "Direct selling Bank as the main body of independent banks", Gao Rui proposed that special regulations on direct selling banks should be issued as soon as possible, defining the direct selling banks clearly and linking them to online banks. E-banking is distinguished from professional supervision as an independent banking model. In the "legal aspects of the binding" trading model of Internet banks on page 98 of our journal, Zhang Bin found that business models characterized by "binding" have swept the Chinese financial industry, but technology has brought about a change in trading patterns. Also doomed to bring the growth of legal risk, must make appropriate response.
