【摘要】：十八屆三中、四中全會分別提出"推進國家治理體系和治理能力現(xiàn)代化"與"全面推進依法治國",完善城鄉(xiāng)規(guī)劃法治建設(shè)、提高治理能力成為當(dāng)下重要的研究課題。文章回顧了新中國成立以來城鄉(xiāng)規(guī)劃法治體系建設(shè)的四個階段,指出了城市規(guī)劃法治建設(shè)的現(xiàn)狀特征和形成原因。在新時期推進依法治國和治理能力現(xiàn)代化的背景下,針對城鄉(xiāng)規(guī)劃法治體系建設(shè)面臨的四個主要挑戰(zhàn),提出了完善規(guī)劃法律體系、建立司法審查制度、加強利益主體參與協(xié)商及加強實施督察等完善城市規(guī)劃法治體系建設(shè)的建議。
[Abstract]:The eighteen session of the third plenary session, the Fourth Plenary Session of the fourth plenary session, respectively proposed to "promote the modernization of national governance system and governance capacity" and "comprehensive promotion of the rule of law", improve the rule of law construction in urban and rural planning, and improve the governance ability to become an important research topic. The article reviews the four stages of the construction of the rule of law system in urban and rural planning since the founding of new China, and points out the city Under the background of promoting the rule of law and the modernization of governance ability in the new period, the four main challenges facing the construction of the rule of law system in urban and rural planning are put forward to perfect the planning legal system, establish the judicial review system, strengthen the stakeholders to participate in the consultation and strengthen the implementation of the supervision. Suggestions on the construction of the rule of law system in good city planning.
