【摘要】:網(wǎng)絡廣告伴隨網(wǎng)絡科技及商務技術發(fā)展不斷更新。但是其在促進網(wǎng)絡經(jīng)濟飛速發(fā)展同時也沖擊了我國現(xiàn)行廣告法律制度。因而深入分析研究網(wǎng)絡廣告法律規(guī)制問題對于適應時代發(fā)展,維護網(wǎng)絡經(jīng)濟穩(wěn)定,規(guī)范廣告行業(yè)秩序具有著重要意義。本文通過四個部分對網(wǎng)絡廣告中法律問題分析研究。第一部通過論述網(wǎng)絡廣告基本理論,明確網(wǎng)絡廣告認知,為網(wǎng)絡廣告法律規(guī)制研究提供理論基礎。第二部通過對我國網(wǎng)絡廣告規(guī)制中存在網(wǎng)絡主體界定不清,網(wǎng)絡內(nèi)容審查和監(jiān)管不到位,相關規(guī)制法律不健全,消費者監(jiān)督作用和行業(yè)自律規(guī)范作用未能有效發(fā)揮等法律問題進行深入研究分析發(fā)掘其產(chǎn)生原因。第三部分對域外網(wǎng)絡廣告法律規(guī)制分析,了解域外規(guī)制情況,總結(jié)和分析各國在這方面值得借鑒的成熟方法。第四部分對我國網(wǎng)絡廣告發(fā)展現(xiàn)狀和規(guī)制情況分析,并結(jié)合域外法律規(guī)制中有益之處為完善我國網(wǎng)絡廣告法律規(guī)制提供幾點建議。全文通過對于網(wǎng)絡廣告法律規(guī)制問題進行深入分析研究,并結(jié)合域外先進理論與實踐經(jīng)驗分析,從而提出盡可能具體的規(guī)制建議,使網(wǎng)絡廣告參與者在市場經(jīng)濟范圍內(nèi)有效發(fā)揮自身作用以促進網(wǎng)絡廣告法律規(guī)制體系建立,使之有益網(wǎng)絡廣告行業(yè)發(fā)展,有益網(wǎng)絡經(jīng)濟秩序穩(wěn)定。
[Abstract]:With the development of network technology and commerce technology, network advertisement is constantly updated.However, it promotes the rapid development of the network economy and also impacts the current advertising legal system of our country.Therefore, it is of great significance to analyze and study the legal regulation of online advertising for adapting to the development of the times, maintaining the stability of the network economy and standardizing the order of the advertising industry.This paper analyzes the legal problems in online advertising through four parts.The first part, through discussing the basic theory of network advertisement, clarifies the cognition of network advertisement, and provides the theoretical basis for the study of legal regulation of network advertisement.In the second part, the definition of network subject is not clear, the examination and supervision of network content is not in place, and the relevant regulation law is not perfect.The legal problems, such as consumer supervision and industry self-regulation, can not be effectively brought into play.The third part analyzes the legal regulation of the extraterritorial network advertising, understand the situation of the extraterritorial regulation, and summarize and analyze the mature methods that countries can use for reference in this respect.The fourth part analyzes the current situation of the development and regulation of China's network advertising, and provides some suggestions for perfecting the legal regulation of the network advertising in our country in combination with the advantages of the extraterritorial legal regulation.Through the deep analysis and research on the legal regulation of network advertisement, and combining with the advanced theory and practical experience of foreign countries, the paper puts forward some suggestions for regulation as much as possible.In order to promote the establishment of the legal regulation system of network advertisement, it is beneficial to the development of network advertising industry and the stability of network economy order to make the participants of network advertisement play their role effectively within the scope of market economy.
