預(yù)付式消費(fèi)退費(fèi)法律制度研究

【摘要】:隨著經(jīng)濟(jì)不斷發(fā)展以及人們生活水平的不斷提高,近年來(lái)預(yù)付式消費(fèi)模式逐漸在人們生活中得到普及。而隨著預(yù)付式消費(fèi)市場(chǎng)的繁榮發(fā)展,能夠?qū)崿F(xiàn)經(jīng)營(yíng)者與消費(fèi)者共贏的預(yù)付式消費(fèi)模式也逐漸得到人們的認(rèn)可。但是由于預(yù)付式消費(fèi)的法律制度存在缺陷,因此實(shí)踐中產(chǎn)生了大量的預(yù)付式消費(fèi)侵權(quán)糾紛,“退費(fèi)難”作為預(yù)付式消費(fèi)糾紛中最為常見(jiàn)的問(wèn)題之一已引起人們的普遍關(guān)注。面對(duì)預(yù)付式消費(fèi)退費(fèi)難的現(xiàn)狀和其存在的問(wèn)題,如何使預(yù)付式消費(fèi)者的退費(fèi)權(quán)得到法律制度的保護(hù)以及如何使預(yù)付式消費(fèi)退費(fèi)制度在實(shí)踐中得到有效的操作已成為目前理論界和實(shí)務(wù)界共同面臨的重要課題。本文主要采用“提出問(wèn)題,分析問(wèn)題,解決問(wèn)題”的基本思路對(duì)該課題進(jìn)行討論,具體來(lái)說(shuō)主要通過(guò)以下四部分進(jìn)行探討。第一部分案例引入及相關(guān)問(wèn)題介紹。該部分通過(guò)引入司法案例,指出預(yù)付式消費(fèi)者退費(fèi)權(quán)利受侵現(xiàn)狀和成因,并試圖對(duì)預(yù)付式消費(fèi)的特征及其對(duì)退費(fèi)制度的影響進(jìn)行闡述,最后指出建立預(yù)付式消費(fèi)退費(fèi)制度的必要性。第二部分預(yù)付式消費(fèi)退費(fèi)制度現(xiàn)狀描述和問(wèn)題分析。該部分首先對(duì)預(yù)付式消費(fèi)退費(fèi)制度的國(guó)內(nèi)和國(guó)外立法現(xiàn)狀進(jìn)行簡(jiǎn)單說(shuō)明,通過(guò)現(xiàn)狀分析提出我國(guó)該制度存在的問(wèn)題并對(duì)問(wèn)題進(jìn)行分析,從而使后文“解決問(wèn)題”的過(guò)程更具針對(duì)性。該部分主要表明我國(guó)預(yù)付式消費(fèi)退費(fèi)制度在預(yù)防性機(jī)制和監(jiān)管機(jī)制上的缺失。預(yù)防性機(jī)制的缺失主要表現(xiàn)在立法不完善、預(yù)付資金管理混亂與經(jīng)營(yíng)者變更混亂等方面,監(jiān)管機(jī)制的不完善主要體現(xiàn)在監(jiān)管主體不明確、合同示范文本不規(guī)范和社會(huì)監(jiān)管力度缺乏等方面。第三部分完善預(yù)付式消費(fèi)退費(fèi)制度。該部分針對(duì)預(yù)付式消費(fèi)退費(fèi)制度所存在的問(wèn)題提出解決建議,建議主要分為完善預(yù)防性機(jī)制和完善監(jiān)管機(jī)制兩方面。預(yù)防性機(jī)制的完善主要通過(guò)完善相關(guān)立法、建立無(wú)理由退費(fèi)制度、建立第三方擔(dān)保交易模式和規(guī)范經(jīng)營(yíng)者變更等方法來(lái)實(shí)現(xiàn),而監(jiān)管機(jī)制的完善主要通過(guò)明確監(jiān)管主體、制定示范合同、建立社會(huì)監(jiān)管防范體系等措施來(lái)實(shí)現(xiàn)。第四部分預(yù)付式消費(fèi)退費(fèi)制度的具體實(shí)施方案設(shè)計(jì)。該部分主要是在前文的理論基礎(chǔ)上,對(duì)預(yù)付式消費(fèi)退費(fèi)制度的實(shí)際操作進(jìn)行規(guī)范,明確退費(fèi)適用情形、退費(fèi)的程序和退費(fèi)的金額計(jì)算方法,同時(shí)從實(shí)質(zhì)公平的視角出發(fā)建議對(duì)預(yù)付式消費(fèi)者退費(fèi)權(quán)利進(jìn)行必要的限制。
[Abstract]:With the development of economy and the improvement of people's living standard, the prepaid consumption pattern has been popularized in recent years.With the prosperous development of prepaid consumption market, the prepaid consumption pattern, which can realize the win-win situation between the operator and the consumer, is gradually accepted by people.However, due to the defects in the legal system of prepaid consumption, a large number of prepaid consumer tort disputes have arisen in practice. As one of the most common problems in prepaid consumption disputes, the problem of "returning fees" has aroused widespread concern.Faced with the current situation and existing problems of prepaid consumption and refund,How to protect the prepaid consumers' right of refund by the legal system and how to make the prepaid consumer refund system operate effectively in practice has become an important subject that both the theoretical and practical circles are faced with at present.This paper mainly uses the basic idea of "raising problems, analyzing problems and solving problems" to discuss this subject, specifically through the following four parts.The first part is the introduction of cases and the introduction of related problems.Through the introduction of judicial cases, this part points out the current situation and causes of infringement of prepaid consumers' right to refund fees, and attempts to expound the characteristics of prepaid consumption and its influence on the system of refund.Finally, it points out the necessity of establishing prepaid consumption refund system.The second part describes the current situation and problem analysis of prepaid consumption refund system.In this part, the domestic and foreign legislative status of the prepaid consumption refund system is briefly explained, and the problems existing in the system are put forward through the analysis of the current situation and the problems are analyzed.In order to make the process of "problem solving" more targeted.This part mainly shows the deficiency of the prepaid consumption refund system in the preventive mechanism and supervision mechanism.The deficiency of the preventive mechanism is mainly reflected in the imperfect legislation, the confusion in the management of prepaid funds and the confusion in the change of the operator, and the imperfection of the supervision mechanism is mainly reflected in the uncertainty of the main body of the supervision.The model text of the contract is not standardized and the social supervision is lacking.The third part consummates the system of prepaid consumption refund.In this part, some suggestions are put forward to solve the problems existing in the prepaid consumption refund system, which are mainly divided into two aspects: to perfect the preventive mechanism and to perfect the supervision mechanism.The perfection of the preventive mechanism is mainly achieved by perfecting the relevant legislation, establishing the system of unjustified refund of fees, establishing the mode of third-party guarantee transaction and standardizing the change of the operator, while the perfection of the supervision mechanism is mainly achieved by clarifying the main body of supervision.Make the model contract, establish the social supervision and guard system and other measures to achieve.The fourth part is the scheme design of prepaid consumption refund system.This part is mainly on the basis of the previous theory to standardize the actual operation of the prepaid consumption refund system, clarify the applicable situation of the refund fee, the procedure of the refund fee and the calculation method of the amount of the refund fee.At the same time, from the point of view of substantive fairness, it is suggested that the rights of prepaid consumers should be restricted.
