【摘要】：正問題甲公司受讓一宗土地,在欠繳土地出讓價款200萬元的情況下辦理了土地使用權(quán)登記。此后,該公司以這塊土地為抵押物,與銀行簽訂了抵押貸款合同�，F(xiàn)甲公司資不抵債進入破產(chǎn)程序,其資產(chǎn)(含該地塊)被拍賣。那么,當?shù)貒临Y源管理部門是否可以"保護國家利益"為由,要求優(yōu)先清償甲公司此前所欠繳的土地出讓價款?
[Abstract]:Is a company transferee a land price of 2 million yuan in arrears of land under the condition of the registration of land use rights. Since then, the company to the land as collateral, signed a mortgage loan contract with the bank. The company insolvent into bankruptcy, its assets (including the land) is auction. So, whether the local land and resources management can protect the interests of the state "on the grounds, require a company priority prior to the payment of the price of land?
