【摘要】：自貿(mào)區(qū)建設(shè)的重要使命是金融創(chuàng)新。上海自貿(mào)區(qū)在金融創(chuàng)新方面的立法實(shí)踐表明,其相關(guān)舉措推動了上海國際金融中心的發(fā)展進(jìn)程,引領(lǐng)著中國金融體系的深刻變革,彰顯了自貿(mào)區(qū)金融創(chuàng)新的廣闊前景。然而,上海自貿(mào)區(qū)金融改革的漸進(jìn)性以及金融"收""放"立法與政策的不匹配,使得改革在金融自由化和金融風(fēng)險(xiǎn)(糾紛)識別上面臨著阻礙。自貿(mào)區(qū)的金融創(chuàng)新立法,應(yīng)當(dāng)進(jìn)一步鞏固和推進(jìn)金融自由化進(jìn)程,加強(qiáng)金融風(fēng)險(xiǎn)(糾紛)的防控與化解,適當(dāng)了解和吸納中國其他金融改革試驗(yàn)區(qū)的有益經(jīng)驗(yàn),從而實(shí)現(xiàn)中國金融改革試驗(yàn)區(qū)的良性互動。
[Abstract]:The important mission of free trade zone construction is financial innovation.The legislative practice of Shanghai Free Trade Zone in financial innovation shows that the related measures have promoted the development process of Shanghai International Financial Center, led the profound reform of China's financial system, and highlighted the broad prospect of financial innovation in the Free Trade Zone.However, the gradual nature of the financial reform in Shanghai Free Trade Zone and the mismatch between the legislation and the policy of "collecting" and "releasing" make the reform face obstacles in financial liberalization and the identification of financial risks (disputes).The legislation on financial innovation in the FTAA should further consolidate and promote the process of financial liberalization, strengthen the prevention, control and resolution of financial risks (disputes), and properly understand and absorb the beneficial experience of other financial reform pilot areas in China.So as to realize the benign interaction of China's financial reform experimental area.
