【摘要】：在當(dāng)今的世界范圍內(nèi),網(wǎng)約車已經(jīng)發(fā)展成為了人們出行的最主要方式之一。因?yàn)榫W(wǎng)約車能夠帶給人們方便、快捷、舒適的出行體驗(yàn),所以得到了廣大人們?nèi)罕姷那嗖A。在2016年7月28日,我國(guó)頒布了《網(wǎng)絡(luò)預(yù)約出租汽車經(jīng)營(yíng)服務(wù)管理暫行辦法》,網(wǎng)約車市場(chǎng)的法律規(guī)制有了明顯的改善,但是仍然存在許多不容忽視的問題。本文旨在順應(yīng)網(wǎng)約車的發(fā)展趨勢(shì),準(zhǔn)確定位網(wǎng)約車,闡明網(wǎng)約車進(jìn)行進(jìn)一步法律規(guī)制的必要性。因?yàn)榫W(wǎng)約車法律規(guī)制能夠很好地緩解交通壓力,解決就業(yè)、保障公民安全等,所以加強(qiáng)法律規(guī)制是必要的。然后歸納總結(jié)出網(wǎng)約車法律規(guī)制過程中存在的問題,例如亂收費(fèi)、黑車泛濫、監(jiān)管無力等。并且本文將從不同角度分析網(wǎng)約車的立法現(xiàn)狀、執(zhí)法狀況、公民的認(rèn)識(shí)以及平臺(tái)的自身建設(shè)等多個(gè)方面,通過這些分析來準(zhǔn)確定位網(wǎng)約車法律規(guī)制問題的關(guān)鍵。最后,介紹國(guó)外網(wǎng)約車法律規(guī)制的發(fā)展歷史以及現(xiàn)狀,引進(jìn)國(guó)外的先進(jìn)經(jīng)驗(yàn)與我國(guó)對(duì)比,并且依據(jù)網(wǎng)約車在我國(guó)的實(shí)際情況,就如何完善我國(guó)網(wǎng)約車的法律規(guī)制提出建議。這些建議包括網(wǎng)約車法律規(guī)制中的立法、執(zhí)法、監(jiān)督、平臺(tái)自治等多個(gè)方面。希望本文能對(duì)網(wǎng)約車的法律規(guī)制研究做出貢獻(xiàn),促進(jìn)我國(guó)網(wǎng)約車行業(yè)的進(jìn)一步發(fā)展。
[Abstract]:In today's world, ride-sharing has become one of the most important ways for people to travel.Because it can bring people convenient, fast and comfortable travel experience, it has been favored by the broad masses of people.On July 28, 2016, China promulgated the "interim measures for the Management of online Taxi booking Service". The legal regulation of the net-ride-sharing market has been improved obviously, but there are still many problems that can not be ignored.The purpose of this paper is to conform to the development trend of net car, to locate the net car accurately, and to clarify the necessity of further legal regulation of net car.It is necessary to strengthen the legal regulation because the legal regulation of ride-sharing can relieve traffic pressure, solve employment and ensure the safety of citizens.Then summarizes the problems in the process of legal regulation, such as random charges, overflowing black cars, weak supervision and so on.And this paper will analyze the current situation of legislation, law enforcement, citizens' understanding and the construction of the platform from different angles. Through these analysis, we can accurately locate the key to the legal regulation of net-ride-hailing.Finally, it introduces the development history and present situation of the legal regulation of ride-hailing in foreign countries, introduces the advanced experience of foreign countries and compares it with our country, and puts forward some suggestions on how to perfect the legal regulation of net-chartered cars in China according to the actual situation in our country.These suggestions include legislation, law enforcement, supervision, platform autonomy and so on.It is hoped that this paper will contribute to the study of the legal regulation and promote the further development of China's ride-hailing industry.
