【摘要】：融資難已經(jīng)成為制約文化創(chuàng)意產(chǎn)業(yè)發(fā)展的瓶頸,現(xiàn)有的融資擔(dān)保法律制度,不利于該產(chǎn)業(yè)獲得資本青睞,相關(guān)法律制度不完善羈絆了該產(chǎn)業(yè)的長足發(fā)展。打破瓶頸,需要著眼于中國立法現(xiàn)狀,同時借鑒吸收一些先進國家成熟的立法經(jīng)驗�？梢酝ㄟ^完善《物權(quán)法》、《擔(dān)保法》對文化創(chuàng)意產(chǎn)業(yè)融資擔(dān)保的相關(guān)規(guī)定,構(gòu)建切實可行的文化創(chuàng)意產(chǎn)業(yè)融資擔(dān)保模式;通過頒布《文化創(chuàng)意產(chǎn)業(yè)政策性信用擔(dān)保法》,建立健全多元化文化創(chuàng)意產(chǎn)業(yè)信用擔(dān)保體系,以健全和完善文化創(chuàng)意產(chǎn)業(yè)融資擔(dān)保的法律體系。
[Abstract]:The difficulty of financing has become the bottleneck of restricting the development of cultural and creative industries. The existing legal system of financing guarantee is not conducive to the industry to get the favor of capital, and the imperfect legal system hinders the rapid development of the industry.To break the bottleneck, we should focus on the current situation of China's legislation and learn from the mature legislative experience of some advanced countries.We can establish a feasible financing guarantee mode of cultural and creative industry by perfecting the relevant provisions of the property Law and the guarantee Law on the financing guarantee of cultural and creative industries.By promulgating the Law of Policy Credit guarantee of Cultural and Creative Industry, the author establishes and perfects the credit guarantee system of multi-cultural creative industry in order to perfect and perfect the legal system of financing guarantee for Cultural and Creative Industry.
