【摘要】：在互聯(lián)網(wǎng)+的時代背景下,各行各業(yè)都在積極的融合到互聯(lián)網(wǎng)當(dāng)中,利用互聯(lián)網(wǎng)先進(jìn)的技術(shù)平臺和優(yōu)化資源分配的能力。專車服務(wù)也不例外,專車服務(wù)正是借助于互聯(lián)網(wǎng)先進(jìn)的技術(shù)優(yōu)勢——打車軟件平臺來運營的。專車服務(wù)的出現(xiàn)給消費者的出行帶來了極大的便利,同時也豐富了消費者的出行方式。但是,專車服務(wù)的出現(xiàn)無疑給傳統(tǒng)的出租車市場帶來了極大的沖擊,傳統(tǒng)的出租車正面臨著專車服務(wù)的沖擊,這也不可避免的導(dǎo)致了一系列社會問題的出現(xiàn)。然而在此情況下,專車服務(wù)也面臨著被取締的巨大威脅。本文從經(jīng)濟(jì)法的視角,對專車服務(wù)的性質(zhì)和其帶來的法律問題以及互聯(lián)網(wǎng)專車發(fā)展過程中市場競爭行為的問題進(jìn)行了分析和研究,并從市場規(guī)制的角度,對專車服務(wù)行業(yè)的改革和發(fā)展提出了建議。本文共分為四個部分:第一部分主要介紹我國專車服務(wù)的基本理論。首先,闡述了專車服務(wù)的概念特點、專車服務(wù)的法律主體和性質(zhì)、專車服務(wù)的未來發(fā)展方向,然后對比分析了專車服務(wù)與類似服務(wù)的關(guān)系;第二部分從經(jīng)濟(jì)法的視角對專車服務(wù)引發(fā)的問題進(jìn)行探討。主要對專車服務(wù)消費者的權(quán)益保護(hù)、專車服務(wù)涉嫌不正當(dāng)競爭和壟斷以及專車服務(wù)資質(zhì)不明確等方面進(jìn)行分析;第三部分闡述了專車服務(wù)在美國以及其他國家的法律規(guī)制現(xiàn)狀,并從中獲得專車服務(wù)法律規(guī)制的經(jīng)驗;第四部分從政府宏觀調(diào)控和專車服務(wù)消費者權(quán)益保護(hù)角度,為我國專車服務(wù)的法律規(guī)制完善提出了建設(shè)性的意見。
[Abstract]:In the background of the Internet era, various industries are actively integrated into the Internet, using the advanced technology platform of the Internet and the ability to optimize resource allocation.Special bus service is no exception. The special bus service is operated with the help of the advanced technology advantage of Internet-ride-hailing software platform.The emergence of special-car service brings great convenience to the travel of consumers, but also enriches the travel mode of consumers.However, the emergence of the special bus service undoubtedly brings a great impact to the traditional taxi market. The traditional taxi is facing the impact of the special car service, which inevitably leads to a series of social problems.However, in this case, the private car service is also facing a huge threat to be banned.From the perspective of economic law, this paper analyzes and studies the nature of the special car service and the legal problems it brings, as well as the market competition behavior in the development of the Internet car, and from the perspective of market regulation.Some suggestions are put forward for the reform and development of the special bus service industry.This paper is divided into four parts: the first part mainly introduces the basic theory of special bus service in China.First of all, it expounds the concept characteristics of the special bus service, the legal subject and nature of the special car service, the future development direction of the special car service, and then compares and analyzes the relationship between the special car service and the similar service.The second part discusses the problems caused by the special bus service from the angle of economic law.It mainly analyzes the protection of the rights and interests of the special car service consumers, the special car service suspected of unfair competition and monopoly, as well as the lack of clear qualification of the special car service. The third part expounds the current situation of the legal regulation of the special car service in the United States and other countries.In the fourth part, from the angle of government macro-control and the protection of consumers' rights and interests, the author puts forward constructive suggestions for the perfection of the legal regulation of the special car service in China.
