【摘要】：原產(chǎn)地是國際貿(mào)易中貨物的“法定國籍”�！皣覍M(jìn)出口貨物施行原產(chǎn)地管理�！边@是我國《對外貿(mào)易法》確定的一項(xiàng)重要外貿(mào)法律制度。我國原產(chǎn)地證書簽發(fā)的相關(guān)法律制度,自改革開放以來從無到有得到了長足發(fā)展。但與歐美發(fā)達(dá)國家的經(jīng)驗(yàn)相比,我國原產(chǎn)地簽證領(lǐng)域的現(xiàn)有法律、規(guī)章在制度設(shè)計(jì)和實(shí)施過程中還存在許多不足。本文寫作目的就是從現(xiàn)行原產(chǎn)地簽證法律制度中找出這些問題加以分析,并提出如何完善的思考和建議。論文共分為三章,每章均以我國現(xiàn)行實(shí)務(wù)領(lǐng)域中的原產(chǎn)地簽證活動為基礎(chǔ)進(jìn)行研究。第一章通過對原產(chǎn)地法律制度的理論解析,厘清實(shí)踐中對原產(chǎn)地有關(guān)概念的理解誤區(qū)；并從法律淵源和適用分類等方面入手對我國原產(chǎn)地簽證法律制度的特征進(jìn)行歸納總結(jié)。第二章主要研究原產(chǎn)地簽證的實(shí)體性規(guī)范,重點(diǎn)對實(shí)體性規(guī)范的核心要素——原產(chǎn)地認(rèn)定標(biāo)準(zhǔn)進(jìn)行審視,探討現(xiàn)行認(rèn)定標(biāo)準(zhǔn)在法律適用中存在的問題,為我國原產(chǎn)地認(rèn)定標(biāo)準(zhǔn)的重構(gòu)提出意見。第三章研究原產(chǎn)地簽證的程序性規(guī)范,以簽證主體規(guī)范、申領(lǐng)填制規(guī)范和簽發(fā)規(guī)范為重點(diǎn)；通過梳理原產(chǎn)地管理機(jī)構(gòu)和簽證機(jī)構(gòu)的職能設(shè)置,分析我國兩大簽證機(jī)構(gòu)的運(yùn)行現(xiàn)狀,以及與國際原產(chǎn)地簽證規(guī)范的對比研究,分別就完善我國的原產(chǎn)地簽證法律制度提出一些理論設(shè)想和建議。
[Abstract]:Origin is the legal nationality of goods in international trade."the State shall administer the origin of imported and exported goods."This is our country's Foreign Trade Law to determine an important foreign trade legal system.China's certificate of origin issued the relevant legal system, since the reform and opening up from scratch has been considerable development.However, compared with the experience of the developed countries in Europe and America, there are still many deficiencies in the design and implementation of the existing laws and regulations in the field of visa of origin in China.The purpose of this paper is to find out these problems from the current legal system of origin visa and put forward some thoughts and suggestions on how to perfect them.The thesis is divided into three chapters. Each chapter is based on the origin visa activities in China.The first chapter clarifies the misunderstanding of the concept of origin in practice through the theoretical analysis of the legal regime of origin, and summarizes the characteristics of the legal system of origin visa in China from the aspects of legal origin and applicable classification.The second chapter mainly studies the substantive norms of the origin visa, focuses on the core element of the substantive norms-the criteria of origin identification, and discusses the existing problems in the legal application of the existing standards.Put forward the opinion for our country origin recognition standard reconstruction.The third chapter studies the procedural norms of the origin visa, focusing on the visa subject norm, the application and filling standard and the issuing norm, and combing the functions of the country of origin administration agency and the visa agency.Based on the analysis of the operation of the two major visa institutions in China and the comparative study with the international rules of origin visa, this paper puts forward some theoretical ideas and suggestions on how to perfect the legal system of the visa of origin in China.
