金融消費(fèi)者隱私權(quán)保護(hù)之法律思考

【摘要】:隨著金融市場(chǎng)發(fā)展的不斷深化,金融產(chǎn)品和服務(wù)日益復(fù)雜化、精細(xì)化和專業(yè)化,進(jìn)一步拉大了本身就處于不對(duì)等地位的消費(fèi)者與經(jīng)營(yíng)者間的差距,由此我們要特別關(guān)注金融消費(fèi)者的保護(hù)。尤其在互聯(lián)網(wǎng)金融浪潮的推動(dòng)下,個(gè)人金融信息具有提升金融機(jī)構(gòu)競(jìng)爭(zhēng)力的潛在價(jià)值,很大程度上激發(fā)了金融經(jīng)營(yíng)者憑借優(yōu)勢(shì)地位對(duì)消費(fèi)者個(gè)人碎片信息進(jìn)行整合利用、進(jìn)而獲取非法利益的熱情。與金融消費(fèi)者個(gè)人金融信息受損這一嚴(yán)峻現(xiàn)實(shí)形成鮮明對(duì)比的是,我國(guó)關(guān)于金融消費(fèi)者隱私權(quán)的立法相對(duì)滯后,目前,不僅沒(méi)有關(guān)于金融消費(fèi)者隱私權(quán)的專門立法,甚至欠缺“金融消費(fèi)者”、“隱私權(quán)”等基礎(chǔ)概念的法律確認(rèn)。鑒于此,本文結(jié)合互聯(lián)網(wǎng)金融和混業(yè)經(jīng)營(yíng)的發(fā)展背景,以金融消費(fèi)者個(gè)人金融信息保護(hù)的必要性為研究切入點(diǎn),通過(guò)深入解讀金融消費(fèi)者隱私權(quán)的保護(hù)現(xiàn)狀,在借鑒域外制度的基礎(chǔ)上,努力探索我國(guó)金融消費(fèi)者隱私權(quán)保護(hù)的發(fā)展路徑。本文的主要思路與觀點(diǎn)如下:第一部分:該部分在扼要梳理金融消費(fèi)者和金融消費(fèi)者隱私權(quán)的界定后,以金融消費(fèi)者的弱勢(shì)性為研究視角,結(jié)合個(gè)人金融需求的普遍高漲、個(gè)人金融信息安全關(guān)切金融市場(chǎng)整體發(fā)展這一現(xiàn)實(shí)背景,解析對(duì)金融消費(fèi)者隱私權(quán)進(jìn)行保護(hù)的必要性。強(qiáng)調(diào)對(duì)金融消費(fèi)者隱私權(quán)的保護(hù),不僅是基于金融消費(fèi)者隱私權(quán)保護(hù)理論探討的要求,更是對(duì)維護(hù)金融市場(chǎng)秩序的現(xiàn)實(shí)回應(yīng)。第二部分:該部分由金融消費(fèi)者個(gè)人金融信息泄露的三個(gè)典型事例引出對(duì)我國(guó)金融消費(fèi)者隱私權(quán)保護(hù)的現(xiàn)狀分析,深入探討在互聯(lián)網(wǎng)金融和混業(yè)經(jīng)營(yíng)的發(fā)展背景下,由于宣傳方式轉(zhuǎn)變、業(yè)務(wù)流程虛擬、金融產(chǎn)品創(chuàng)新等原因給個(gè)人金融信息保護(hù)帶來(lái)的現(xiàn)實(shí)挑戰(zhàn),同時(shí)配合立法現(xiàn)狀的展呈,于理論摸索與實(shí)踐照應(yīng)雙重視角探進(jìn)對(duì)金融消費(fèi)者隱私權(quán)的保護(hù)。第三部分:該部分主要以金融消費(fèi)者隱私權(quán)保護(hù)機(jī)制的宏觀思路構(gòu)建為主題,在對(duì)歐美個(gè)人金融信息保護(hù)相關(guān)制度進(jìn)行引介與借鑒的基礎(chǔ)上,結(jié)合我金融發(fā)展現(xiàn)實(shí),嘗試從立法保護(hù)理念、價(jià)值平衡、立法模式選擇方面考量,提出義務(wù)保護(hù)本位向權(quán)利保護(hù)本位的轉(zhuǎn)變,建議實(shí)現(xiàn)信息流通與保護(hù)價(jià)值的合理平衡,并倡議采用逐步統(tǒng)合的立法保障模式。第四部分:該部分延承上文宏觀層面的認(rèn)知定位,具體展開(kāi)對(duì)金融消費(fèi)者隱私權(quán)保護(hù)機(jī)制的構(gòu)建工作。以歐美的先進(jìn)經(jīng)驗(yàn)為參鑒樣本,主要從立法的完善、保護(hù)機(jī)構(gòu)的設(shè)立、教育工作的進(jìn)行、救濟(jì)機(jī)制的構(gòu)設(shè)等角度,為我國(guó)金融消費(fèi)者隱私權(quán)的法律完善提供微觀層面的具體建議。
[Abstract]:As the development of financial markets deepens, financial products and services become increasingly complex, refined and specialized, further widening the gap between consumers and operators, who are themselves in unequal positions. As a result, we should pay special attention to the protection of financial consumers. In particular, driven by the wave of Internet finance, personal financial information has the potential value of enhancing the competitiveness of financial institutions. To a large extent, the enthusiasm of financial operators to integrate and utilize consumer personal debris information by virtue of their dominant position, thereby obtaining illegal benefits, stands in sharp contrast to the grim reality that financial consumers' personal financial information is damaged. China's legislation on the right to privacy of financial consumers is relatively lagging behind. At present, there is not only no specific legislation on the right to privacy of financial consumers, but also a lack of legal confirmation of the basic concepts of "financial consumers" and "privacy rights". Based on the background of the development of Internet finance and mixed operation, this paper takes the necessity of financial consumer's personal financial information protection as the starting point, through deeply analyzing the present situation of the financial consumer's privacy protection, and on the basis of the reference of the extraterritorial system. The main ideas and viewpoints of this paper are as follows: the first part: after briefly combing the definition of the right to privacy of financial consumers and financial consumers, From the perspective of the weakness of financial consumers and the general upsurge of personal financial needs, personal financial information security concerns about the overall development of financial markets. Analyzing the necessity of protecting the right to privacy of financial consumers, emphasizing that the protection of the right of privacy of financial consumers is not only based on the requirements of the theoretical discussion on the protection of privacy of financial consumers, The second part: from the three typical examples of financial consumers' personal financial information leakage leads to the analysis of the current situation of the protection of financial consumers' right to privacy in China. Under the background of the development of Internet finance and mixed business operation, the realistic challenges brought to personal financial information protection due to the change of propaganda mode, the virtual business process, the innovation of financial products, and so on, are discussed in depth, and the present situation of legislation is presented at the same time. This part explores the protection of financial consumers' right to privacy from the perspective of theoretical exploration and practical reference. Part III: the main theme of this part is the macro thinking construction of financial consumers' privacy protection mechanism. Based on the introduction and reference of the relevant systems of personal financial information protection in Europe and the United States, combined with the reality of our financial development, this paper tries to consider the concept of legislative protection, the balance of value, and the choice of legislative model. The paper puts forward the shift from the obligation protection standard to the right protection standard, proposes to achieve a reasonable balance between the information flow and the protection value, and proposes to adopt the legislative protection mode of gradual integration. Part IV: this part extends the cognitive orientation of the macroscopic level above. Taking the advanced experience of Europe and the United States as a reference sample, mainly from the perspective of the perfection of legislation, the establishment of protection institutions, the carrying out of education work, the construction of relief mechanism, etc. To provide micro-level specific suggestions for the legal perfection of the right to privacy of financial consumers in China.
