【摘要】：在當(dāng)今社會,人民生活水平顯著提高,選擇旅游作為休閑娛樂方式的人越來越多,旅行行業(yè)也同樣處在迅速發(fā)展時(shí)期。由于事物的矛盾性原理,在旅游業(yè)中糾紛是屬于正�，F(xiàn)象,只要我們抓住關(guān)鍵問題所在,便可以順利解決問題,目前旅行社的安全保障義務(wù)問題便是旅游業(yè)中的關(guān)鍵問題。在實(shí)踐中一般側(cè)重對旅游者的保護(hù)利益的傾斜,當(dāng)發(fā)生損害時(shí)會要求旅行社承擔(dān)賠償責(zé)任,隨著相關(guān)旅游法律制度的健全,要更加注重公平合理原則,使旅行社在過錯(cuò)范圍內(nèi)承擔(dān)責(zé)任。明確規(guī)定其責(zé)任的認(rèn)定和承擔(dān)這樣可以更好的促進(jìn)旅游業(yè)良好發(fā)展。筆者在本文中論述了旅行社安全保障義務(wù)的相關(guān)性質(zhì)、認(rèn)定和第三人介入的問題,并重點(diǎn)對實(shí)踐中一些復(fù)雜情況進(jìn)行分析。本文由三大部分組成,各部分主要內(nèi)容如下:首先是對旅行社安全保障義務(wù)的相關(guān)理論進(jìn)行論述和結(jié)合現(xiàn)實(shí)生活中真實(shí)案例進(jìn)行分析,寫作的主要目的是明確旅行社安全保障義務(wù)的認(rèn)定,主要從旅游活動(dòng)中旅游環(huán)境的安全認(rèn)定、導(dǎo)游的適格、告知義務(wù)、救助義務(wù)進(jìn)行分析。其中第一節(jié)是案情簡介和爭議焦點(diǎn);第二節(jié)說明旅行社安全保障義務(wù)的性質(zhì)理論依據(jù);第三節(jié)旅行社安全保障義務(wù)的認(rèn)定;第四節(jié)是綜合案例進(jìn)行解析。其次主要是針對旅行社違反安全保障義務(wù)責(zé)任認(rèn)定與承擔(dān)的論述。通過對旅行社按照過錯(cuò)原則,特殊情況下的舉證責(zé)任倒置,承擔(dān)的責(zé)任方式為違約和侵權(quán)兩種方式對其詳細(xì)的闡述,結(jié)合真實(shí)判例,綜合分析在此案件中法官審判的思路其裁決結(jié)果的正確性。其中第一節(jié)是案情簡介和爭議焦點(diǎn);第二節(jié)是旅行社違反安全保障義務(wù)的認(rèn)定;第三節(jié)旅行社未盡到安全保障義務(wù)責(zé)任承擔(dān);第四節(jié)案例綜合解析。最后對旅行社已盡安全保障義務(wù)情況下游客受到損害的責(zé)任承擔(dān)的論述。以公平公正原則和受益原則為基礎(chǔ),在旅行社盡到安全保障義務(wù)后,可以對受害人的損失不進(jìn)行賠償,而由旅游輔助人直接進(jìn)行賠償。第一節(jié)案例簡介和爭議焦點(diǎn),第二節(jié)旅行社防止第三人侵權(quán)的義務(wù)分析,第三節(jié)旅游客車服務(wù)公司未盡到安全保障義務(wù)造成游客損害責(zé)任承擔(dān),第四節(jié)案例解析。從而明確旅行社和旅游輔助人第三人侵權(quán)時(shí)的責(zé)任承擔(dān)問題。
[Abstract]:In today's society, the standard of living of the people has improved significantly. More and more people choose tourism as a form of leisure and entertainment. The travel industry is also in a period of rapid development. Disputes are a normal phenomenon in the tourism industry. As long as we grasp the key problems, we can solve the problems smoothly. At present, the problem of travel agency's security obligation is a key problem in tourism industry. In practice, the travel agency is generally focused on the protection of tourists' interests and will be required to bear the liability of compensation when damage occurs. With the improvement of the relevant legal system on tourism, it is necessary to pay more attention to the principle of fairness and reasonableness. In this paper, the author discusses the related nature of the travel agency's duty of safety and security, which can better promote the good development of the tourism industry, so that the travel agency should bear the responsibility within the scope of its fault, and clearly stipulate its responsibility and assume the responsibility, so as to promote the good development of the tourism industry. Identification and involvement of third parties, and analysis of some complex situations in practice. This paper consists of three major parts. The main contents of each part are as follows: first of all, it discusses the related theories of travel agency security obligations and analyzes the real cases in real life.
