臺(tái)灣民間參與公共建設(shè)評(píng)審問(wèn)題研究及其啟示

【摘要】:在十八屆三中全會(huì)提出“允許社會(huì)資本通過(guò)特許經(jīng)營(yíng)等方式參與城市基礎(chǔ)設(shè)施投資和運(yùn)營(yíng)”的改革方向之后,PPP模式在我國(guó)迎來(lái)新一輪的發(fā)展浪潮。PPP模式核心是公共部門(mén)和私營(yíng)部門(mén)通過(guò)建立一種長(zhǎng)期的合作伙伴關(guān)系提供公共服務(wù),實(shí)現(xiàn)公共部門(mén)、私營(yíng)部門(mén)、社會(huì)公共利益的三方共贏。因此評(píng)選出最佳的私營(yíng)部門(mén)進(jìn)行合作對(duì)于PPP項(xiàng)目的成功至關(guān)重要。本文通過(guò)研究我國(guó)臺(tái)灣地區(qū)《促進(jìn)民間參與公共建設(shè)法》(簡(jiǎn)稱《促參法》)在評(píng)審階段出現(xiàn)的立法及實(shí)踐問(wèn)題,結(jié)合我國(guó)大陸PPP評(píng)審現(xiàn)狀,對(duì)PPP的評(píng)審環(huán)節(jié)提出相關(guān)建議,以期更好的推動(dòng)PPP在我國(guó)的發(fā)展。首先,根據(jù)《促參法》評(píng)審規(guī)范要求分析評(píng)審的應(yīng)然狀態(tài)。主要包括《促參法》關(guān)于評(píng)審的主要規(guī)定和《民間參與公共建設(shè)評(píng)審委員會(huì)組織及評(píng)審辦法》(簡(jiǎn)稱《評(píng)審辦法》)對(duì)《促參法》的細(xì)化!洞賲⒎ā分饕獜挠擅耖g參與公共建設(shè)的公告、評(píng)審委員會(huì)的設(shè)置及評(píng)審原則等方面對(duì)評(píng)審環(huán)節(jié)進(jìn)行規(guī)范!对u(píng)審辦法》則對(duì)評(píng)審委員會(huì)的任務(wù)、人員組成、委員選任方式、委員禁止情形、委員回避情形等作出了進(jìn)一步細(xì)化。其次,以ETC案為切入點(diǎn)分析臺(tái)灣地區(qū)民間參與公共建設(shè)評(píng)審存在的主要問(wèn)題,即評(píng)審的實(shí)然狀態(tài),并在分析其原因的基礎(chǔ)上提出解決建議。本部分認(rèn)為評(píng)審階段主要存在四個(gè)方面的問(wèn)題,包括評(píng)審委員會(huì)設(shè)置不合理、評(píng)審程序規(guī)范不足、評(píng)審結(jié)果公告的法律性質(zhì)不明、評(píng)審決定的司法審查標(biāo)準(zhǔn)缺乏。最后,通過(guò)對(duì)大陸PPP評(píng)審現(xiàn)狀的分析,吸取臺(tái)灣地區(qū)經(jīng)驗(yàn)教訓(xùn),提出相關(guān)啟示。PPP統(tǒng)一立法尚未出臺(tái),推廣時(shí)間尚短,若要實(shí)現(xiàn)健康有序發(fā)展,同樣需要克服過(guò)去招投標(biāo)評(píng)審中存在的頑疾。如評(píng)審專家缺乏公正性、專注性、可問(wèn)責(zé)性;投標(biāo)人串標(biāo)、圍標(biāo)現(xiàn)象嚴(yán)重;行政機(jī)關(guān)的不合理行政干預(yù);法院對(duì)招投標(biāo)評(píng)審的審查僅為粗略程序?qū)彽。在上述研究基礎(chǔ)上,本文對(duì)此提出了相關(guān)對(duì)策。
[Abstract]:After the third Plenary session of the 18 CPC Central Committee put forward the reform direction of "allowing social capital to participate in the investment and operation of urban infrastructure by means of franchise", the core of the PPP model in China is a new wave of development. The public sector and the private sector provide public services through a long-term partnership, The public sector, the private sector, Therefore, the selection of the best private sector cooperation is very important to the success of the PPP project. This paper studies the "promoting Private participation in Public Construction Law" in Taiwan area of China (abbreviated as "promoting Private participation in Public Construction"). The legislative and practical problems that arise during the evaluation stage, According to the current situation of PPP review in mainland China, this paper puts forward some suggestions on the review of PPP in order to better promote the development of PPP in China. According to the requirements of the evaluation criterion of the law of promoting participation, the paper analyzes the status of the review. It mainly includes the main provisions of the law on the promotion of membership and the measures for the organization and evaluation of the civil participation in the public construction review and evaluation committee (abbreviated as the "office for review and evaluation"). Methods >) refinement of the Law on the Promotion of Public participation. The public notice of participation in public construction by the people is the main part of the Law on the Promotion of participation in the Promotion of people's participation. The establishment and evaluation principles of the review and appraisal committee shall regulate the evaluation links. The "measures for evaluation" shall deal with the task, composition, selection and appointment of the members of the review and appraisal committee, and the prohibition of the members, Second, the ETC case is taken as a starting point to analyze the main problems existing in Taiwan's non-governmental participation in the review of public construction, that is, the actual status of the review. Based on the analysis of the reasons, the author puts forward some suggestions. This part considers that there are four main problems in the review stage, including unreasonable setting of the review committee, insufficient standard of the review procedure, unclear legal nature of the announcement of the results of the review. Finally, through the analysis of the current situation of the PPP review in the mainland, drawing lessons from the experience and lessons of the Taiwan region, the author puts forward the relevant enlightenment... The unified legislation has not yet been promulgated, and the promotion time is still short. If we want to achieve healthy and orderly development, It is also necessary to overcome the stubborn problems existing in the past bidding evaluation, such as the lack of impartiality, concentration and accountability of the evaluation experts, the serious phenomenon of the bidders' bundling and the unreasonable administrative intervention of the administrative organs; The court's examination of tender evaluation is only rough procedure, etc. On the basis of the above research, this paper puts forward some relevant countermeasures.
