黑龍江省城鄉(xiāng)規(guī)劃法規(guī)政策體系建設(shè)研究

【摘要】:近年來,特別是2008年國(guó)家《城鄉(xiāng)規(guī)劃法》出臺(tái)后,黑龍江省城鄉(xiāng)規(guī)劃編制、實(shí)施和管理工作取得了長(zhǎng)足進(jìn)步,規(guī)劃行業(yè)整體社會(huì)地位顯著提升,但是在國(guó)家全面深化改革、全面依法治國(guó)、推進(jìn)城鎮(zhèn)化建設(shè)和城鄉(xiāng)規(guī)劃問題日益凸顯的背景下,在全省經(jīng)濟(jì)、社會(huì)、法治、城鄉(xiāng)建設(shè)等各方面發(fā)生變化的情況下,城鄉(xiāng)規(guī)劃工作同時(shí)面臨著發(fā)展的瓶頸和轉(zhuǎn)型的機(jī)遇,由于地方法規(guī)制度的缺失和滯后,無法可依、法不符實(shí)、法規(guī)矛盾問題比較普遍,城鄉(xiāng)規(guī)劃依法行政特別是在市縣層面面臨較大壓力,健全完善城鄉(xiāng)規(guī)劃法制體系是省市當(dāng)前面臨的十分緊迫的重要任務(wù)。本文在對(duì)國(guó)家、省、市三個(gè)層面城鄉(xiāng)規(guī)劃法制建設(shè)情況進(jìn)行回顧、梳理和總結(jié)的基礎(chǔ)上,認(rèn)為目前黑龍江省城鄉(xiāng)規(guī)劃法規(guī)政策存在一些突出問題,主要包括法規(guī)和政策的制定修訂滯后、體系不夠完善、法律效力較弱、缺乏多向的銜接協(xié)調(diào)、地方特色不夠鮮明等等。研究認(rèn)為,黑龍江省城鄉(xiāng)規(guī)劃法規(guī)政策體系建設(shè)的總體目標(biāo)應(yīng)當(dāng)是適應(yīng)黑龍江省城鄉(xiāng)規(guī)劃管理體制和當(dāng)前的省情,建立一套既能貫徹國(guó)家法規(guī)和政策精神,又能解決本省熱點(diǎn)和難點(diǎn)問題,體現(xiàn)地方特點(diǎn)、切實(shí)可行、健全完善的地方城鄉(xiāng)規(guī)劃法規(guī)政策體系,為黑龍江省城鄉(xiāng)規(guī)劃的編制、實(shí)施和管理提供法制保障。研究提出,黑龍江省城鄉(xiāng)規(guī)劃法規(guī)政策體系建設(shè)應(yīng)遵循“適用、層次、側(cè)重、協(xié)調(diào)、效能”的基本原則。在借鑒國(guó)內(nèi)外經(jīng)驗(yàn)的基礎(chǔ)上,提出了黑龍江省城鄉(xiāng)規(guī)劃法規(guī)政策體系建設(shè)的優(yōu)化策略,主要包括提高制定效率、創(chuàng)新城鄉(xiāng)規(guī)劃法制化方式方法、明晰法定權(quán)限和約束邊界、建立溝通協(xié)調(diào)機(jī)制、加強(qiáng)法規(guī)政策的評(píng)估和執(zhí)行監(jiān)督以及提升城鄉(xiāng)規(guī)劃文本的法律效力,最后,借鑒云南等省市經(jīng)驗(yàn),從構(gòu)成形式、完善內(nèi)容、構(gòu)建時(shí)序三個(gè)方面進(jìn)行分析研究,提出黑龍江省城鄉(xiāng)規(guī)劃法規(guī)政策體系的基本框架,并對(duì)設(shè)區(qū)的市城鄉(xiāng)規(guī)劃法制建設(shè)提出工作原則、優(yōu)化方式、完善內(nèi)容等方面相關(guān)建議。
[Abstract]:In recent years, especially after the promulgation of the National Law on Urban-Rural Planning in 2008, great progress has been made in the preparation, implementation and management of urban and rural planning in Heilongjiang Province, and the overall social status of the planning industry has improved significantly, but the overall reform has been deepened in the country. Under the background of comprehensively governing the country according to law, promoting urbanization and urban and rural planning, and under the circumstances of changes in the province's economy, society, rule of law, urban and rural construction, and so on, At the same time, the urban and rural planning work is facing the bottleneck of development and the opportunity of transformation. Due to the lack and lag of the local laws and regulations, they cannot abide by the law, the law does not conform to the reality, and the contradiction between the laws and regulations is relatively common. The administration of urban and rural planning according to law, especially at the city and county level, is under great pressure. Perfecting the legal system of urban and rural planning is an urgent and important task facing provinces and cities. On the basis of reviewing, combing and summing up the legal construction of urban and rural planning at the three levels of the city, the author thinks that there are some outstanding problems in the laws and policies of urban and rural planning in Heilongjiang Province at present, mainly including the lagging behind in the formulation and revision of laws and policies. The system is not perfect, the legal effect is relatively weak, there is a lack of multi-directional convergence and coordination, the local characteristics are not clear enough, and so on. The overall goal of the construction of the policy system of urban and rural planning laws and regulations in Heilongjiang Province should be to adapt to the management system of urban and rural planning in Heilongjiang Province and to establish a set of policies that can not only carry out the national laws and policies, but also solve the hot and difficult problems in this province. Reflecting the local characteristics, feasible and sound local urban and rural planning laws and policies system, providing legal guarantee for the compilation, implementation and management of urban and rural planning in Heilongjiang Province. The construction of the policy system of urban and rural planning laws and regulations in Heilongjiang Province should follow the basic principles of "application, hierarchy, emphasis, coordination and efficiency". This paper puts forward the optimization strategy of the construction of urban and rural planning laws and policies system in Heilongjiang Province, which mainly includes improving the efficiency of urban and rural planning, innovating the method of legalization of urban and rural planning, clarifying the legal authority and binding boundary, establishing communication and coordination mechanism. Strengthen the evaluation and supervision of laws and regulations, and improve the legal effectiveness of urban and rural planning text. Finally, from the experience of Yunnan province and other provinces and cities, from the form of composition, perfect content, construction of time series to carry on the analysis and research. This paper puts forward the basic framework of the policy system of urban and rural planning laws and regulations in Heilongjiang Province, and puts forward some relevant suggestions on the construction of urban and rural planning legal system in Heilongjiang Province in terms of working principles, optimizing methods, perfecting contents, and so on.
