【摘要】:本文先分析我國(guó)構(gòu)建綜合運(yùn)輸法律的概念、發(fā)展?fàn)顩r以及對(duì)我國(guó)綜合運(yùn)輸?shù)囊饬x,后分別從縱向和橫向兩個(gè)角度分析我國(guó)綜合運(yùn)輸法律的改革與完善,前者從公路、鐵路、水運(yùn)和航空四個(gè)方面展開論述,后者以《鹿特丹規(guī)則》為例展開對(duì)我國(guó)綜合運(yùn)輸民事立法的完善建議。最后,結(jié)合前文的公法和私法兩方面的闡述,提出構(gòu)建我國(guó)綜合運(yùn)輸法律的立法構(gòu)想。本篇論文除引言和結(jié)論外,共包含四部分:第一章:綜合運(yùn)輸法律概述,介紹了綜合運(yùn)輸法律概念和特征、綜合運(yùn)輸法律與物流法和多式聯(lián)運(yùn)法律的區(qū)別,并提出我國(guó)構(gòu)建綜合運(yùn)輸法律的意義和迫切需要。第二章:展開介紹我國(guó)綜合運(yùn)輸管理法律和民事法律的發(fā)展現(xiàn)狀。對(duì)公路、鐵路、航空和水運(yùn)四種運(yùn)輸方式的國(guó)內(nèi)立法進(jìn)行分析。第三章:參考外國(guó)綜合運(yùn)輸法律的發(fā)展歷程和制定方法。先介紹美國(guó)、日本和德國(guó)的綜合運(yùn)輸管理法律,后以《荷蘭民法典》和《德國(guó)商法典》為例介紹發(fā)達(dá)國(guó)家的綜合運(yùn)輸民事法律。因現(xiàn)階段綜合運(yùn)輸民事方面法律發(fā)展不成熟的社會(huì)現(xiàn)狀,而《鹿特丹規(guī)則》又首次大膽嘗試將“海上+其他”的運(yùn)輸方式共同調(diào)整的創(chuàng)新,對(duì)《鹿特丹規(guī)則》的發(fā)展模式進(jìn)行介紹。第四章:借鑒國(guó)外經(jīng)驗(yàn)和我國(guó)發(fā)展現(xiàn)狀,在完善單一運(yùn)輸方式的法律的基礎(chǔ)上,根據(jù)我國(guó)國(guó)情制定適合我國(guó)的綜合運(yùn)輸法律,分別對(duì)管理法律和民事法律的銜接部分加以調(diào)整,使綜合運(yùn)輸立法更好地起到促進(jìn)綜合運(yùn)輸發(fā)展的需求。
[Abstract]:This paper first analyzes the concept, development and significance of the construction of integrated transport law in China, and then analyzes the reform and perfection of the comprehensive transport law in China from the vertical and horizontal angles, the former from the highway and the railway. Water transportation and aviation are discussed in four aspects. The latter takes Rotterdam rules as an example to put forward some suggestions on the improvement of China's comprehensive transport civil legislation. Finally, combining the above two aspects of public and private law, In addition to the introduction and conclusion, this paper consists of four parts: chapter one: an overview of integrated transport law, introducing the concept and characteristics of integrated transport law. The difference between the integrated transport law and the logistics law and the multimodal transport law, and the significance and urgent need of constructing the integrated transport law in our country are put forward. Chapter two: the development status of the comprehensive transport management law and the civil law in our country is introduced. Analysis of domestic legislation on four modes of transport: railway, air and water transport. Chapter three: referring to the development and formulation of foreign integrated transport laws. First introduce the integrated transport management laws of the United States, Japan and Germany. Then take the Dutch Civil Code and the German Commercial Code as examples to introduce the comprehensive transport civil law in developed countries. The Rotterdam rules are the first bold attempt to bring forth the innovation of "other modes of transport at sea" and introduce the development model of the "Rotterdam rules". Chapter 4th: drawing lessons from foreign experience and the present situation of development in China, On the basis of perfecting the law of single mode of transport, and according to the national conditions of our country, to formulate comprehensive transport law suitable for our country, and to adjust the linking part of management law and civil law respectively. So that the integrated transport legislation better play to promote the development of integrated transport needs.
