【摘要】：相對于預算法層面的制度缺失,預算參與在地方的法治化探索中呈現(xiàn)出豐富多元的發(fā)展格局,形成了預算決策參與、預算執(zhí)行參與和預算問責參與三種法治進路。地方在自發(fā)進行制度創(chuàng)新方面顯示出能動姿態(tài),提供了完善預算參與法治建構(gòu)、實現(xiàn)預算治理與預算民主理念的經(jīng)驗范本及具體途徑。但是,地方預算參與法治進路也面臨因外部制度障礙與自身局限帶來的運行限度。要克服法治改革固有的路徑依賴,擴展地方預算參與的制度經(jīng)驗,還面臨諸多困境。在發(fā)揮地方驅(qū)動制度變遷的優(yōu)勢基礎上,預算法應有針對性地進行自上而下的調(diào)整,克服預算參與的制度創(chuàng)新障礙、確立統(tǒng)一的預算參與權利依據(jù)并推廣預算問責參與法治化。
[Abstract]:Compared with the lack of system in the level of budget law, budget participation presents a rich and diversified pattern of development in the exploration of local rule of law, which forms the participation in budget decision-making. Budget implementation participation and budget accountability participation are three approaches to the rule of law. The local government shows a dynamic attitude in spontaneously carrying out institutional innovation, which provides a perfect budget participation in the construction of the rule of law. The experience model and concrete way of realizing the concept of budget governance and budget democracy. However, the path of local budget participation in the rule of law also faces the operating limits brought by the external system obstacles and its own limitations, so as to overcome the inherent path dependence of the rule of law reform. On the basis of giving full play to the advantages of local driven institutional changes, the Budget Law should adjust from top to bottom in order to overcome the obstacles of system innovation in budget participation. Establish a unified budget participation right basis and promote budget accountability participation in the rule of law.
