【摘要】：比特幣與各國法定貨幣之間能夠進行低成本兌換,并可藉此實現(xiàn)人民幣與外幣的間接跨境兌換,對我國外匯犯罪刑法規(guī)制實踐產(chǎn)生實質(zhì)的沖擊。利用比特幣交易實施的騙購?fù)鈪R、逃匯、非法經(jīng)營外匯業(yè)務(wù)、隱瞞境外存款等外匯犯罪行為,在既有的貨幣監(jiān)管規(guī)則與刑法規(guī)范解釋框架下難以認定為犯罪。金融刑法有必要在立法、司法與執(zhí)法層面進行全維度的制度優(yōu)化,以應(yīng)對基于區(qū)塊鏈技術(shù)的比特幣等"去中心化"互聯(lián)網(wǎng)金融工具對外匯犯罪刑事法律體系的沖擊,從而有效維護我國的貨幣與外匯市場安全。
[Abstract]:Bitcoin can be exchanged at a low cost with the legal currencies of various countries, thus allowing for indirect cross-border convertibility of the renminbi and foreign currencies. It has a substantial impact on the practice of criminal regulation of foreign exchange crimes in China. Foreign exchange fraud, foreign exchange flight, illegal operation of foreign exchange business, concealment of foreign deposits, and other foreign exchange crimes implemented by Bitcoin transactions, It is difficult to be regarded as a crime under the existing rules of monetary supervision and interpretation of criminal norms. It is necessary for the financial criminal law to optimize the whole system in the aspects of legislation, judicature and law enforcement. In order to deal with the impact of "decentralization" of Internet financial instruments such as Bitcoin based on blockchain technology on the criminal legal system of foreign exchange crime, the paper effectively maintains the security of China's currency and foreign exchange markets.
