關(guān)于明星虛假代言的案例研究

【摘要】:近年來,明星虛假代言的現(xiàn)象頻繁出現(xiàn),由此而產(chǎn)生的訴訟糾紛數(shù)量也日益增長。為了規(guī)范日益嚴(yán)重的明星虛假代言現(xiàn)象,我國新修改的《消費(fèi)者權(quán)益保護(hù)法》中首次明確了明星虛假代言行為的連帶責(zé)任。但由于該規(guī)定對(duì)于明星代言人承擔(dān)連帶責(zé)任的規(guī)定過于簡單,同時(shí)缺乏操作性,因而不能很好的遏制虛假宣傳代言的行為。除了最新施行的《消費(fèi)者權(quán)益保護(hù)法》之外,我國《廣告法》和《食品安全法》等法律也從不同的角度對(duì)虛假代言行為進(jìn)行了規(guī)定。但從實(shí)踐情況看,我國現(xiàn)有的法律在一些地方仍然存在著缺陷,在一定程度上導(dǎo)致虛假廣告日益泛濫的情況難以得到根本的遏制,因此我國的相關(guān)立法還需要不斷進(jìn)行完善。為了更好的解決上述問題,完善我國關(guān)于明星虛假代言法律責(zé)任的立法,文章首先通過對(duì)三個(gè)典型明星虛假代言廣告案例的介紹,總結(jié)出了虛假代言案例中的五個(gè)主要的爭議焦點(diǎn),并且根據(jù)案件的爭議焦點(diǎn)引申出了在明星虛假代言案件中普遍涉及且存在爭議的五個(gè)法律問題,分別是虛假廣告的定義及其認(rèn)定標(biāo)準(zhǔn)、明星虛假代言行為的現(xiàn)行法律責(zé)任分析、明星虛假代言行為的歸責(zé)原則分析、明星虛假代言行為的構(gòu)成要件分析以及明星虛假代言行為的侵權(quán)損害賠償原則分析,并對(duì)這五個(gè)法律問題進(jìn)行了詳盡深入的分析。然后通過對(duì)國內(nèi)外關(guān)于明星虛假代言廣告立法的分析,從中發(fā)現(xiàn)我國當(dāng)前立法中關(guān)于明星虛假代言行為的立法缺陷以及有關(guān)國家或地區(qū)立法中值得我國借鑒的地方。最后在前文研究的基礎(chǔ)之上,提出了完善虛假廣告代言人的民事責(zé)任、構(gòu)建虛假廣告代言人的行政責(zé)任和規(guī)定虛假廣告代言人的刑事責(zé)任三個(gè)關(guān)于完善我國明星虛假代言法律責(zé)任的立法建議,希望可以對(duì)規(guī)范我國明星代言行為提供一些幫助。
[Abstract]:In recent years, the phenomenon of false endorsement of stars appears frequently, and the number of litigation disputes arising therefrom is also increasing. In order to regulate the increasingly serious phenomenon of false endorsement of stars. In the newly amended Consumer Rights and interests Protection Law, the joint liability of star's false endorsement is defined for the first time. However, it is too simple for the celebrity spokesman to bear the joint and several liability. At the same time, the lack of maneuverability, so it can not be very good to curb the behavior of false propaganda endorsements, in addition to the latest implementation of the Consumer Rights and interests Protection Act. The advertising law and food safety law of our country have also stipulated the act of false endorsement from different angles. However, from the practical situation, the existing laws of our country still have defects in some places. To a certain extent, it is difficult to contain the situation that the false advertisement is overflowing day by day. Therefore, the relevant legislation of our country still needs to be perfected continuously. In order to solve the above problem better. Improve our legislation on the legal liability of false endorsement of stars, the article first through the introduction of three typical cases of false endorsements of stars, summed up the five main controversial focus of false endorsement cases. And according to the dispute focus of the case, it generalizes five legal issues which are generally involved and controversial in the case of false endorsement of star, namely, the definition of false advertisement and its identification standard. The analysis of the current legal liability of the star's false endorsements and the analysis of the imputation principle of the star's false endorsements. Analysis of the elements of star false endorsement act and star false endorsement of tort damage compensation principle analysis. And the five legal issues of the detailed and in-depth analysis. Then through the analysis of the domestic and foreign legislation on the false endorsement of the star advertising legislation. Find out the current legislation of our country on the act of false endorsement of stars legislative defects and relevant national or regional legislation worthy of our reference. Finally on the basis of the previous study. Put forward to perfect the civil liability of false advertising spokesman. Constructing the administrative responsibility of false advertisement spokesman and stipulating the criminal responsibility of false advertisement spokesman three suggestions on perfecting the legal responsibility of false endorsement of star in our country. We hope to provide some help for standardizing the behavior of star endorsements in our country.
