網(wǎng)約車合法化構(gòu)成對出租車牌照的管制性征收

【摘要】:網(wǎng)約車合法化,本質(zhì)上是政府放松對出租車的管制,尤其是放松對出租車的進入管制。網(wǎng)約車合法化后,原有出租車經(jīng)營者的利潤遭遇沖擊。原有出租車營運牌照是一項牌照持有人支付了對價的特許,體現(xiàn)牌照持有人的財產(chǎn)權(quán),受征收規(guī)范保護。網(wǎng)約車合法化克減了原有出租車營運牌照持有人的財產(chǎn)權(quán),破壞了原有出租車投資者基于公平競爭權(quán)的合理投資預(yù)期,構(gòu)成對原有出租車營運牌照的管制性征收,應(yīng)該分門別類補償原有出租車營運牌照持有人的損失。
[Abstract]:The legalization of netting is essentially a relaxation of the government's regulation of taxis, especially the deregulation of taxi entry. The original taxi operator's profit has been hit. The original taxi operating licence is a licence holder who pays the price, which reflects the property rights of the licence holder. Under the protection of the expropriation norms, the legalization of the net car renouncing reduces the property rights of the original taxi operating licence holders, and undermines the reasonable investment expectations of the original taxi investors based on the right to fair competition. A regulatory levy on the original taxi operating licence should be made up of categories to compensate the loss of the original taxi operating licence holder.
