【摘要】：建設(shè)工程是我國國民經(jīng)濟(jì)發(fā)展中的一個重要載體,其作為支柱產(chǎn)業(yè),不僅促進(jìn)了國民經(jīng)濟(jì)的發(fā)展,而且也滿足了千萬民眾的生活需要。正因為建設(shè)工程的地位與作用,與之相關(guān)的一系列制度便應(yīng)運(yùn)而生,其中最能引起爭論的便是建設(shè)工程保證金制度。該制度的出現(xiàn),在一定程度上有利于建設(shè)工程的順利開展,但另一方面,因為其存在某些問題,而未能達(dá)到預(yù)期的效果。有關(guān)建設(shè)工程保證金的規(guī)定,并未形成完整的體系,下位法與上位法不統(tǒng)一,在適用中極為混亂。這些問題的存在,并不利于建筑行業(yè)的健康有序發(fā)展,甚至可能引發(fā)嚴(yán)重的社會問題。為此,國務(wù)院于2016年6月23日下發(fā)了《關(guān)于清理規(guī)范工程建設(shè)領(lǐng)域保證金的通知》(以下簡稱《通知》),以期使該制度更加完善,從而發(fā)揮其應(yīng)有的意義。鑒于此,筆者將在此基礎(chǔ)上繼續(xù)進(jìn)行探究,以論證該《通知》的頒行所帶來的意義,繼續(xù)發(fā)現(xiàn)其存在的問題并提出相應(yīng)的建議。論文的寫作共分為四個部分,第一部分是從定義、分類等方面著手,分別論述了投標(biāo)保證金、履約保證金、質(zhì)量保證金、農(nóng)民工工資保證金四類建設(shè)工程保證金。同時,筆者還將四類保證金的繳納、退還、性質(zhì)等進(jìn)行了梳理,以表格的方式呈現(xiàn),以便再接下來的論述中能夠有的放矢。第二部分是以《通知》的下發(fā)為分界點(diǎn),對《通知》下發(fā)前后該制度的不同進(jìn)行了對比,分析了《通知》下發(fā)前該制度的意義、弊端,以及《通知》下發(fā)后該制度的進(jìn)步之處。同時,筆者還對某建筑公司所繳納的建設(shè)工程保證金做了實證研究,以求對接下來問題的提出有所幫助。第三部分則是提出了建設(shè)工程保證金制度存在的問題,在該部分中,筆者分別從該制度總的方面和各類建設(shè)工程保證金進(jìn)行了分析,既找出了該制度整體存在的問題,也對每一類建設(shè)工程保證金的個性問題進(jìn)行了分析。第四部分則是與第三部分相對應(yīng)的若干建議,也是從建設(shè)工程保證金的整體和每一類進(jìn)行入手,使得每項問題都有不同的建議與之對應(yīng),以期使問題得到恰當(dāng)?shù)慕鉀Q。
[Abstract]:Construction project is an important carrier in the development of our national economy. As a pillar industry, it not only promotes the development of the national economy. And also meet the needs of tens of millions of people. Because of the status and role of construction projects, a series of related systems came into being. One of the most controversial is the construction project margin system, the emergence of this system, to a certain extent, conducive to the smooth development of construction projects, but on the other hand, because of its existence of some problems. But failed to achieve the expected results. The provisions of the construction project margin, did not form a complete system, the lower law and the upper law is not unified, in the application of extremely chaotic. These problems exist. It is not conducive to the healthy and orderly development of the construction industry, and may even lead to serious social problems. On June 23rd 2016, the State Council issued the notice on the margin in the field of cleaning up the standard engineering construction (hereinafter referred to as "notice") in order to make the system more perfect. In view of this, the author will continue to explore on this basis, in order to demonstrate the significance of the promulgation of the notice. The paper is divided into four parts. The first part is from the definition, classification and other aspects, respectively discussed the tender bond, performance bond. Quality margin, migrant workers wage margin four types of construction margin. At the same time, the author will also four types of margin payment, refund, nature and so on are combed, presented in the form of the form. In order to be able to focus on the following discussion. The second part is the "notice" as the demarcation point, the system before and after the "notice" is compared. This paper analyzes the significance and disadvantage of the system before the notice is issued, and the progress of the system after the notice is issued. At the same time, the author also makes an empirical study on the construction project margin paid by a construction company. The third part is to put forward the construction project margin system problems, in this part. From the overall aspects of the system and the analysis of all kinds of construction project margin, the author has found out the problems of the system as a whole. The author also analyzes the personality of each kind of construction project margin. Part 4th is a number of suggestions corresponding to the third part, and it also starts from the whole and each category of the construction project margin. So that each problem has different suggestions and corresponding, so that the problem is properly resolved.
