【摘要】:對(duì)互聯(lián)網(wǎng)征信數(shù)據(jù)采集存在的法律問(wèn)題進(jìn)行研究是在互聯(lián)網(wǎng)征信快速發(fā)展以及國(guó)家倡導(dǎo)“互聯(lián)網(wǎng)+”和“大數(shù)據(jù)”戰(zhàn)略的時(shí)代大背景下開(kāi)展的。數(shù)據(jù)采集作為互聯(lián)網(wǎng)征信中最基礎(chǔ)的一個(gè)環(huán)節(jié),其為之后產(chǎn)生高價(jià)值的信用產(chǎn)品發(fā)揮著不可替代的作用。目前,關(guān)于互聯(lián)網(wǎng)征信數(shù)據(jù)采集的相關(guān)規(guī)范主要集中體現(xiàn)在《征信業(yè)管理?xiàng)l例》、《征信機(jī)構(gòu)管理辦法》、《征信機(jī)構(gòu)監(jiān)管指引》和《電信和互聯(lián)網(wǎng)用戶(hù)個(gè)人信息保護(hù)規(guī)定》等,但其對(duì)數(shù)據(jù)采集的內(nèi)容僅做了原則性規(guī)定,需要進(jìn)一步細(xì)化。除此之外,信息主體權(quán)益的保護(hù)、機(jī)構(gòu)之間的數(shù)據(jù)共享以及數(shù)據(jù)采集的監(jiān)管問(wèn)題都應(yīng)該引起重視。本文第一章是對(duì)互聯(lián)網(wǎng)征信數(shù)據(jù)采集的概述。本章探討了互聯(lián)網(wǎng)征信數(shù)據(jù)采集的相關(guān)理論,對(duì)數(shù)據(jù)采集和互聯(lián)網(wǎng)征信的基礎(chǔ)理論進(jìn)行梳理,界定了互聯(lián)網(wǎng)征信數(shù)據(jù)采集的概念,分析了其法律關(guān)系,并從采集機(jī)構(gòu)性質(zhì)、采集對(duì)象、采集數(shù)據(jù)的時(shí)效性、采集覆蓋范圍和采集數(shù)據(jù)應(yīng)用領(lǐng)域五個(gè)方面,以央行征信系統(tǒng)為視角將傳統(tǒng)征信與互聯(lián)網(wǎng)征信數(shù)據(jù)采集進(jìn)行比較分析。本文第二章分別從法律和市場(chǎng)兩個(gè)角度對(duì)國(guó)內(nèi)外相關(guān)互聯(lián)網(wǎng)征信數(shù)據(jù)采集的現(xiàn)狀進(jìn)行了梳理和討論。本文第三章以芝麻信用為例對(duì)互聯(lián)網(wǎng)征信數(shù)據(jù)采集的行為進(jìn)行分析。重點(diǎn)對(duì)芝麻信用征信過(guò)程中數(shù)據(jù)采集模式進(jìn)行法律分析,挖掘在征信數(shù)據(jù)采集中存在的法律風(fēng)險(xiǎn)。本文第四章以國(guó)內(nèi)外互聯(lián)網(wǎng)征信數(shù)據(jù)采集發(fā)展中存在的差異以及芝麻信用在采集數(shù)據(jù)過(guò)程中存在的法律風(fēng)險(xiǎn)為基礎(chǔ),探討了我國(guó)互聯(lián)網(wǎng)征信數(shù)據(jù)采集中存在的法律問(wèn)題。主要包括:信息主體在權(quán)益保護(hù)方面面臨一些法律困境,比如信息主體權(quán)益存在損害風(fēng)險(xiǎn)、數(shù)據(jù)采集缺少明確的標(biāo)準(zhǔn)以及個(gè)人信息保護(hù)立法進(jìn)程緩慢;在征信機(jī)構(gòu)之間、互聯(lián)網(wǎng)征信機(jī)構(gòu)和央行征信系統(tǒng)之間以及互聯(lián)網(wǎng)征信機(jī)構(gòu)和其他機(jī)構(gòu)之間缺乏有效的數(shù)據(jù)共享機(jī)制;數(shù)據(jù)采集監(jiān)管體系不完備,主要體現(xiàn)在監(jiān)管主體單一、監(jiān)管形式滯后以及監(jiān)管制度落后等方面,需要改進(jìn)與創(chuàng)新。本文第五章針對(duì)互聯(lián)網(wǎng)征信數(shù)據(jù)采集過(guò)程中發(fā)現(xiàn)的問(wèn)題,提出相應(yīng)的完善建議。即,通過(guò)降低信息主體權(quán)益損害風(fēng)險(xiǎn)、明確互聯(lián)網(wǎng)征信數(shù)據(jù)采集標(biāo)準(zhǔn)和加快個(gè)人信息保護(hù)立法進(jìn)程來(lái)加強(qiáng)信息主體的權(quán)益保護(hù);通過(guò)提高征信機(jī)構(gòu)之間數(shù)據(jù)共享意愿、推動(dòng)央行征信系統(tǒng)和互聯(lián)網(wǎng)征信機(jī)構(gòu)有效對(duì)接、促進(jìn)互聯(lián)網(wǎng)征信機(jī)構(gòu)和其他機(jī)構(gòu)之間數(shù)據(jù)共享來(lái)促進(jìn)機(jī)構(gòu)之間數(shù)據(jù)共享;通過(guò)促進(jìn)互聯(lián)網(wǎng)征信數(shù)據(jù)采集監(jiān)管主體多元化、創(chuàng)新互聯(lián)網(wǎng)征信數(shù)據(jù)采集監(jiān)管手段以及健全互聯(lián)網(wǎng)征信數(shù)據(jù)采集相關(guān)監(jiān)管制度來(lái)完善互聯(lián)網(wǎng)征信數(shù)據(jù)采集的法律監(jiān)管。
[Abstract]:The research on the legal problems in the data collection of Internet credit information is based on the rapid development of Internet credit information and the national advocacy of "Internet" and "big data". Under the background of the era of strategy, data acquisition is one of the most basic links in Internet credit information. It plays an irreplaceable role in the production of high value credit products. At present, the relevant norms about the data collection of Internet credit information are mainly embodied in the "Credit Information Industry Management regulations". The "measures for the Administration of Credit investigation agencies", the "guidelines on Supervision and Control of Credit investigation agencies" and the "provisions on the Protection of personal Information of Telecommunications and Internet users", etc., however, only provide in principle for the contents of data collection. In addition, the protection of the rights and interests of the information subject. The data sharing among institutions and the supervision of data collection should be paid attention to. The first chapter is an overview of Internet credit data collection. This chapter discusses the relevant theory of Internet credit data collection. The basic theory of data acquisition and Internet credit collection is combed, the concept of Internet credit data collection is defined, the legal relationship is analyzed, and from the nature of the collection organization, the object of collection, the timeliness of data collection. Acquisition coverage and data acquisition application in five areas. From the perspective of the central bank credit system, the traditional credit information and the internet credit data collection are compared and analyzed. The second chapter analyzes the current situation of internet credit data collection at home and abroad from the angle of law and market. The third chapter takes Sesame credit as an example to analyze the behavior of Internet credit data collection, and focuses on the legal analysis of the data collection model in the process of Sesame credit reporting. Chapter 4th is based on the differences in the development of Internet credit data collection and the legal risk of Sesame credit in the process of collecting data. This paper probes into the legal problems existing in the data collection of Internet credit information in China, including: the information subject faces some legal difficulties in the protection of rights and interests, such as the risk of damage to the rights and interests of the information subject. Lack of clear standards for data collection and slow legislative process for the protection of personal information; There is a lack of effective data sharing mechanism between the Internet credit agencies and the central bank credit system, as well as between the Internet credit agencies and other institutions; Data collection supervision system is not complete, mainly reflected in the single regulatory body, the form of supervision lag and the backward regulatory system and so on. We need to improve and innovate. Chapter 5th of this paper aims at the problems found in the process of data collection of Internet credit information, and puts forward corresponding suggestions. That is, by reducing the risk of damage to the rights and interests of information subjects. To strengthen the protection of the rights and interests of the information subject by clarifying the data collection standard of Internet credit information and speeding up the legislative process of personal information protection; By improving the willingness of data sharing among credit agencies, promoting the effective docking between the credit system of the central bank and the Internet credit agencies, and promoting the data sharing between Internet credit agencies and other institutions to promote the data sharing among institutions; Through the promotion of Internet credit data collection regulatory body diversification. To improve the legal supervision of Internet credit data collection, we should innovate the supervision means of Internet credit data collection and improve the relevant supervision system of Internet credit data collection.
