【摘要】：出版商在與圖書館數(shù)據(jù)資源交易過程中利用其版權(quán)壟斷地位濫用許可權(quán),有可能排除、破壞、妨礙或者限制競爭,擾亂正常的市場秩序。所以,用反壟斷法對數(shù)字資源出版商濫用許可權(quán)的行為予以規(guī)制具有堅實的法理基礎(chǔ)。數(shù)字資源出版商濫用許可權(quán)的行為包括"搭配銷售""價格控制""拒絕許可""權(quán)利限制"等。由于版權(quán)適用反壟斷法例外原則,因此這些行為并非都必定會受到反壟斷法的追究,需要針對具體情況分析判斷。我國調(diào)整知識產(chǎn)權(quán)許可的反壟斷立法有待完善,切入點包括科學(xué)選擇政策取向、開展專門性立法、建立詳細(xì)的操作指南、確定違法審查標(biāo)準(zhǔn)等。
[Abstract]:Publishers use its monopoly position in the copyright and library data resources in the transaction process of abuse of license may exclude, damage, hinder or restrict competition, disrupt the normal market order. So, with the anti-monopoly law on abuse of digital resources publisher permission to conduct regulation has a solid legal basis. The publisher of digital resources abuse license the right behavior includes "collocation sales" price control "refused to permit" restriction of rights. Due to copyright exceptions of anti-monopoly law principle, so not all these behaviors will be subject to antitrust investigation, the specific circumstances of the need for analysis and judgment. Adjust the licensing of intellectual property rights of China's anti-monopoly legislation to be perfect the starting point, including the scientific selection policy, to carry out special legislation, establish specific guidelines, determine the illegal examination standards.
