【摘要】： 近年來,隨著陸地資源的曰趨短缺,海洋已成為人類可持續(xù)發(fā)展的寶貴財富。然而,人類開發(fā)利用海洋活動的不斷增多,海洋環(huán)境污染也日趨嚴重。海洋工程造成的海洋環(huán)境污染已成為我國海洋環(huán)境污染的又一大污染源。 本文分了五部分對防治海洋工程污染海洋環(huán)境這一問題進行了研究。 第一部分重點闡述了海洋工程的內(nèi)涵,對海洋工程這一定義在法律上重新作了界定。 第二部分對海洋工程造成海洋環(huán)境污染的成因進行了分析,海洋生態(tài)系統(tǒng)的相對獨立性和海洋環(huán)境利益主體的缺位,使得防治海洋工程污染的困難重重。 第三部分介紹了我國防治海洋工程污染海洋環(huán)境的法律規(guī)定,分析了其中存在的問題。 第四部分是關于海洋工程污染防治的國際立法的內(nèi)容及對我國的啟示。 最后一部分通過對上述內(nèi)容的分析研究,筆者提出了完善海洋工程污染防治制度的建議。一是要修改海洋工程污染防治的相關法律規(guī)定,二是要健全和完善我國海洋工程污染防治管理制度。
[Abstract]:In recent years, with the shortage of land resources, the ocean has become a valuable asset of human sustainable development. However, with the increasing development and utilization of marine activities, the pollution of marine environment is becoming more and more serious. The marine environmental pollution caused by marine engineering has become another major pollution source of marine environmental pollution in China. This paper is divided into five parts to study the problem of preventing and controlling marine environment pollution by marine engineering. The first part focuses on the connotation of marine engineering, and redefines the definition of marine engineering in law. The second part analyzes the causes of marine environmental pollution caused by marine engineering. The relative independence of marine ecosystem and the absence of marine environmental stakeholders make it difficult to prevent and control marine engineering pollution. The third part introduces the legal provisions of preventing and controlling marine environment pollution by marine engineering in China, and analyzes the existing problems. The fourth part is about the content of international legislation on marine engineering pollution prevention and control and its enlightenment to our country. In the last part, through the analysis and research of the above contents, the author puts forward some suggestions to improve the pollution prevention and control system of marine engineering. First, it is necessary to revise the relevant legal provisions for the prevention and control of marine engineering pollution, and the other is to improve and improve the management system of marine engineering pollution prevention and control in China.
