【摘要】：低碳發(fā)展已經(jīng)成為各國發(fā)展戰(zhàn)略中的重要組成部分,但是資源稟賦和經(jīng)濟(jì)發(fā)展模式差異導(dǎo)致實(shí)現(xiàn)低碳發(fā)展的困難程度迥然,山西省作為我國重要的能源重化工基地是名副其實(shí)的高碳大省,如何在山西省實(shí)現(xiàn)低碳發(fā)展直接關(guān)系到我國低碳發(fā)展的前進(jìn)步伐。山西省高碳現(xiàn)狀的原因在于產(chǎn)業(yè)結(jié)構(gòu)不合理,高耗能產(chǎn)業(yè)產(chǎn)能過剩,效率低下,而更深層次的法律原因則是民商法與經(jīng)濟(jì)法這一對(duì)調(diào)整市場經(jīng)濟(jì)關(guān)系的法律規(guī)制不到位。解決山西省高碳問題的關(guān)鍵是要正確適用民商法理順市場關(guān)系,并且運(yùn)用經(jīng)濟(jì)法實(shí)現(xiàn)高耗能產(chǎn)業(yè)轉(zhuǎn)型發(fā)展,走一條以煤為基多元發(fā)展的道路。
[Abstract]:Low-carbon development has become an important part of national development strategies, but differences in resource endowments and economic development models have led to difficulties in achieving low-carbon development. Shanxi Province, as an important base of energy and heavy chemical industry in China, is a real high-carbon province. How to realize low-carbon development in Shanxi Province is directly related to the progress of low-carbon development in our country. The reason of high-carbon situation in Shanxi province is that the industrial structure is unreasonable, the energy-consuming industry is overcapacity and the efficiency is low, and the deeper legal reason is that the civil and commercial law and economic law, the legal regulation of adjusting the relationship of market economy, are not in place. The key to solve the high-carbon problem in Shanxi Province is to correctly apply the civil and commercial laws to straighten out the market relations, and to use economic law to realize the transformation and development of high-energy-consuming industries, and to take a road of multi-element development based on coal.
