【摘要】：將土地制度與環(huán)境保護(hù)法律制度聯(lián)系起來,并結(jié)合目前存世的各類古籍,可以證明:中國古代環(huán)境保護(hù)法制經(jīng)歷了從西周時(shí)期相對(duì)完備到明清時(shí)期極度衰弱的演變過程,推動(dòng)力則是土地所有制變革。秦漢時(shí)期封建土地所有制興起,西周時(shí)期與土地原始國有制相適應(yīng)的環(huán)保法制體系開始解體;隋唐時(shí)期,新的功能被弱化的環(huán)保法制基本成型;明清時(shí)期,與高度發(fā)達(dá)的封建土地私有制相適應(yīng),環(huán)保法制已經(jīng)被極度"虛化"。
[Abstract]:Linking the land system with the legal system of environmental protection, and combining the ancient books of the present world, it can be proved that the legal system of environmental protection in ancient China experienced the evolution from the relatively complete period of the Western Zhou Dynasty to the extremely weak period of the Ming and Qing dynasties. The driving force is the change of land ownership. The feudal land ownership arose in Qin and Han dynasties, the environmental protection legal system adapted to the original state ownership of land began to disintegrate in the Western Zhou Dynasty, the new function was basically formed in the Sui and Tang dynasties, and the environmental protection legal system was basically formed in the Sui and Tang dynasties. In Ming and Qing dynasties, with the highly developed private ownership of feudal land, environmental protection legal system has been extremely "virtual".
