【摘要】：碳排放權(quán)伴隨國(guó)際上應(yīng)對(duì)全球氣候變化而得以產(chǎn)生和發(fā)展,我國(guó)的碳排放權(quán)法律制度是我國(guó)應(yīng)對(duì)國(guó)際氣候公約、國(guó)際責(zé)任以及國(guó)內(nèi)氣候變化問(wèn)題的法律制度。然而,我國(guó)對(duì)于碳排放權(quán)的現(xiàn)有法律調(diào)整并不完善,僅停留在傳統(tǒng)環(huán)境法、行政法的調(diào)控層面,不能有效控制碳排放行為。因此,本文立足民法視角,適用民法規(guī)則來(lái)完善我國(guó)的碳排放權(quán)法律制度。碳排放權(quán)盡管具有公權(quán)色彩,但由于又具有物權(quán)屬性,再結(jié)合權(quán)利本身的特性,本質(zhì)上為具有準(zhǔn)物權(quán)屬性的私權(quán)。因此,在立法模式的選擇上,可以借鑒我國(guó)準(zhǔn)物權(quán)的立法模式,采取物權(quán)法宣示性規(guī)定與特別法規(guī)定相結(jié)合的模式。在具體的立法規(guī)定設(shè)計(jì)上,應(yīng)以現(xiàn)有的物權(quán)體系為基礎(chǔ),借鑒國(guó)際法上的實(shí)踐做法,結(jié)合碳排放權(quán)本身的特點(diǎn),明確我國(guó)碳排放權(quán)的取得方式與條件、權(quán)利變更的具體規(guī)則、權(quán)利的消滅、權(quán)利公示方法與效力、權(quán)利保護(hù)方式等制度。從而,更好地調(diào)整企業(yè)的碳排放活動(dòng),為企業(yè)間碳排放權(quán)轉(zhuǎn)讓行為提供法律依據(jù)。
[Abstract]:Carbon emission rights come into being and develop with the international response to global climate change. The legal system of carbon emission rights in China is the legal system to deal with the international climate convention, international responsibility and domestic climate change. However, the existing legal adjustment of carbon emission right in China is not perfect. It only stays on the level of traditional environmental law and administrative law, and can not effectively control the carbon emission behavior. Therefore, based on the perspective of civil law, this paper applies civil law rules to improve the legal system of carbon emission rights in China. Although carbon emission right has the color of public right, it is a private right with quasi-real right attribute in essence because it has the property of real right and combined with the characteristic of right itself. Therefore, in the choice of legislative mode, we can draw lessons from the legislative model of quasi-real right in our country, and adopt the mode of combining declarative provisions of property law with special law provisions. In the design of specific legislative provisions, based on the existing real right system, drawing lessons from the practice of international law and combining the characteristics of carbon emission rights themselves, we should make clear the ways and conditions for obtaining carbon emission rights and the specific rules for the change of rights in our country. The elimination of the right, the method and effect of the publicity of the right, the way of the protection of the right and so on. Thus, the carbon emission activities of enterprises should be better adjusted to provide legal basis for the transfer of carbon emission rights between enterprises.
