【摘要】：目標(biāo)考核制是當(dāng)前環(huán)境治理領(lǐng)域廣泛采用的治理手段之一,它具有任務(wù)具體化、責(zé)任明確化和考核剛性化等特點,并且在實踐中取得顯著成效。然而,從塑造性行政中行政機關(guān)應(yīng)享有塑造自由的視角分析,目標(biāo)考核制度可能導(dǎo)致衡量懈怠、衡量過度、破壞整體行政等瑕疵。因此,為保存行政的形成性、自主性和裁量性等核心價值,應(yīng)慎重看待環(huán)境治理中的目標(biāo)考核制度。
[Abstract]:Objective assessment system is one of the widely used governance methods in the field of environmental governance at present. It has the characteristics of specific tasks, clear responsibilities and rigid assessment, and has achieved remarkable results in practice. However, from the angle of view that the administrative organs should enjoy the freedom of shaping in the moulding administration, the system of objective assessment may lead to the defects of measurement slack, overmeasurement and the destruction of the whole administration. Therefore, in order to preserve the core values of administration, such as formability, autonomy and discretion, the objective assessment system in environmental governance should be treated with caution.
