【摘要】：隨著經(jīng)濟(jì)建設(shè)的快速發(fā)展,湘江流域生態(tài)環(huán)境惡化問題日益突出,已經(jīng)嚴(yán)重影響了兩型社會的建立,亟待強(qiáng)有力的立法予以治理。而目前適用的《湖南省湘江流域水污染防治條例》(以下簡稱《條例》)出現(xiàn)了明顯的滯后性,無法承擔(dān)這一重任,對《條例》進(jìn)行修改勢在必行。 湘江目前的污染狀況、新.《水污染防治法》的重大修訂、湖南兩型社會的建設(shè)為條例的修訂提出內(nèi)在要求,而相關(guān)水污染立法的出臺、湘江水污染防治的實踐、湘江水污染防治立法理論探討又為條例的修訂提供了法律基礎(chǔ)、物質(zhì)條件和理論支持。 現(xiàn)行《條例》目前存在許多問題,這些問題主要有：在立法目的上存在偏差,在管理體制上無法適應(yīng)流域管理要求,在管理過程中政府問責(zé)機(jī)制缺失,法律責(zé)任條款設(shè)置不合理。要做好湘江水污染防治,就必須針對這些問題,在立法上予以完善：應(yīng)當(dāng)重構(gòu)立法目的,建立流域與區(qū)域相結(jié)合的管理體制,健全政府問責(zé)機(jī)制,建立問責(zé)指標(biāo)體系,完善法律責(zé)任體系,建立環(huán)境污染責(zé)任險制度,將污染損害救濟(jì)法律機(jī)制與社會機(jī)制有機(jī)結(jié)合。
[Abstract]:With the rapid development of economic construction, the problem of ecological environment deterioration in Xiangjiang River Basin has become increasingly prominent, which has seriously affected the establishment of a two-type society and needs to be dealt with by strong legislation. However, the "regulations of Xiangjiang River Basin of Hunan Province" (hereinafter referred to as "regulations"), which is applicable at present, is obviously lagging behind, so it is imperative to amend the regulations. The current pollution situation of the Xiangjiang River, the major revision of the "Water pollution Prevention and Control Law", the construction of a two-type society in Hunan put forward inherent requirements for the revision of the regulations, and the enactment of relevant water pollution legislation and the practice of preventing and controlling water pollution in the Xiangjiang River, The discussion of Xiangjiang River water pollution prevention legislation theory provides the legal basis, material condition and theoretical support for the amendment of the regulations. At present, there are many problems in the current regulations, such as the deviation in the legislative purpose, the inability of the management system to adapt to the requirements of watershed management, and the lack of government accountability mechanism in the management process. The setting of legal liability clause is unreasonable. In order to prevent and control the water pollution of Xiangjiang River, we must perfect the legislation in view of these problems: we should reconstruct the legislative purpose, establish the management system of combining the watershed with the region, perfect the government accountability mechanism, and establish the accountability index system. Perfect the legal liability system, establish the environmental pollution liability insurance system, and combine the legal mechanism of pollution damage relief with the social mechanism organically.
