【摘要】： 隨著我國(guó)經(jīng)濟(jì)的快速發(fā)展,環(huán)境污染問(wèn)題日益嚴(yán)重,我國(guó)人民面臨著嚴(yán)峻的生存危機(jī)。甚至有人將環(huán)境問(wèn)題比喻為第三次世界大戰(zhàn),認(rèn)為如果任由人類(lèi)對(duì)環(huán)境的侵略繼續(xù)下去,必然導(dǎo)致人類(lèi)自身的最終滅亡。環(huán)境權(quán)是作為自然生命的人存在和發(fā)展的基本前提,是任何人所固有的不可或缺、不可替代、不可轉(zhuǎn)讓并不能分割的權(quán)利。因此,環(huán)境權(quán)被視為一項(xiàng)基本人權(quán)已被世界絕大多數(shù)國(guó)家所認(rèn)同。環(huán)境權(quán)被確認(rèn)為基本人權(quán)的根本目的在于在更高的層次上保護(hù)和改善人類(lèi)環(huán)境。對(duì)此,作為保護(hù)公民基本權(quán)利的憲法應(yīng)作出積極的反應(yīng),將公民的環(huán)境權(quán)升格為基本人權(quán),以憲法的明確規(guī)定保護(hù)公民環(huán)境權(quán)。同時(shí),在此基礎(chǔ)上,明確環(huán)境權(quán)的內(nèi)容,通過(guò)建立和完善一系列的程序、制度,確保我國(guó)公民環(huán)境權(quán)的實(shí)現(xiàn)。
[Abstract]:With the rapid development of our economy, environmental pollution is becoming more and more serious, and our people are facing a severe survival crisis. Some people even liken the environmental problem to the third World War, and think that if human aggression on the environment is allowed to continue, it will inevitably lead to the ultimate extinction of mankind itself. The right to environment is the basic prerequisite for the existence and development of human being as a natural life, and it is an indispensable, irreplaceable and non-transferable right that can not be separated by any human being. Therefore, the right to environment has been recognized as a basic human right by most countries in the world. The fundamental purpose of the recognition of the right to environment as a basic human right is to protect and improve the human environment at a higher level. In this regard, the constitution, which protects the basic rights of citizens, should make a positive response, upgrade the environmental rights of citizens to basic human rights, and protect the environmental rights of citizens by the explicit provisions of the Constitution. At the same time, on the basis of this, the content of environmental rights is clarified, and a series of procedures and systems are established and perfected to ensure the realization of environmental rights of Chinese citizens.
