【摘要】： 在人類對自然環(huán)境改造的過程中,工業(yè)化在促進經(jīng)濟發(fā)展和改善人類生活質(zhì)量方面的確作出了巨大的貢獻,但與此同時,環(huán)境問題也日益突顯出來。人們在生產(chǎn)和生活中大規(guī)模地開采礦藏、肆無忌憚地開發(fā)利用資源、不計后果地排放廢物,使得人類與自然環(huán)境的沖突越來越嚴重。為了人類自身利益的需要,許多國家逐漸認識到保護環(huán)境的重要性,制定了一系列的法律、法規(guī),期望以此來緩解人與自然間的緊張關系。中國也加入了這樣的隊伍中,先后制定了很多保護環(huán)境的基本法律、單行法、行政法規(guī)、地方性法規(guī)等等。必須承認,這些法律法規(guī)確實起到了一定的作用,但收效卻不是很明顯。這就需要我們進行反思——立法的價值根基是否發(fā)生了偏離? 本文正是通過對環(huán)境法的挖掘、闡釋,以期找到以上問題的答案。首先從國外和國內(nèi)兩個角度介紹了環(huán)境法的確立過程。其次從我國環(huán)境法本身所具有的價值、所要促進的價值和不同價值間的平衡三個方面分析了我國環(huán)境法的價值取向。最后,重點論述了環(huán)境法的價值根基——人類中心主義和生態(tài)主義,即倫理主體向自然環(huán)境的拓展、代際正義和代內(nèi)平等問題的提出以及生態(tài)主義在環(huán)境法律實踐中的滲透。 通過以上的介紹、分析和闡釋,我們表明,一方面是在環(huán)境法領域,生態(tài)主義已經(jīng)風靡全球,同時進而是人心所向,大勢所趨,“人類中心主義”的不足已為人類所認知。另一方面揭示出論證了我國現(xiàn)行環(huán)境立法中價值背離的問題。希望我國的立法機關,能夠轉變立法思路,修改那些不符合環(huán)境法價值根基的法律、法規(guī),切實促進社會的可持續(xù)發(fā)展,并最終實現(xiàn)人與自然的和諧相處。
[Abstract]:In the process of transformation of natural environment, industrialization has made great contributions in promoting economic development and improving the quality of human life, but at the same time, environmental problems have become increasingly prominent. People in the production and life of large-scale mining, unscrupulous exploitation and utilization of resources, regardless of the consequences of the discharge of waste, making the conflict between human beings and the natural environment is becoming more and more serious. For the sake of human self-interest, many countries have gradually realized the importance of protecting the environment, and have formulated a series of laws and regulations, which are expected to ease the tension between man and nature. China has also joined the ranks, and has enacted many basic laws, administrative regulations, local laws and so on to protect the environment. Admittedly, these laws and regulations do play a role, but the results are not obvious. This requires us to reflect on whether the value of legislation has deviated? This paper aims to find out the answers to the above questions by excavating and explaining the environmental law. Firstly, the establishment process of environmental law is introduced from two angles of foreign and domestic. Secondly, this paper analyzes the value orientation of Chinese environmental law from three aspects: the value of environmental law itself, the value to be promoted and the balance between different values. Finally, the value foundation of environmental law, anthropocentrism and ecologicalism, is discussed, that is, the expansion of ethical subject to the natural environment, the issue of intergenerational justice and intra-generational equality, and the infiltration of ecologicalism in the practice of environmental law. Through the above introduction, analysis and explanation, we show that, on the one hand, in the field of environmental law, ecologism has become popular all over the world, at the same time, it is the general trend of the people, and the deficiency of "anthropocentrism" has been recognized by human beings. On the other hand, it demonstrates the problem of value deviation in the current environmental legislation of our country. It is hoped that the legislature of our country will change its legislative thinking, amend those laws and regulations that do not conform to the value foundation of environmental law, promote the sustainable development of society and finally realize the harmony between man and nature.
