【摘要】：資源型城市在發(fā)展中普遍面臨資源利用率低、環(huán)境污染嚴(yán)重和經(jīng)濟(jì)發(fā)展乏力的困難,對(duì)此學(xué)術(shù)界提出調(diào)整產(chǎn)業(yè)結(jié)構(gòu)以促使資源型城市轉(zhuǎn)型的研究。本文以西部資源型城市為研究對(duì)象,從法律的視角分析西部資源型城市轉(zhuǎn)型困境的形成原因,通過(guò)對(duì)國(guó)內(nèi)外資源型城市轉(zhuǎn)型的實(shí)證分析,借鑒其有益經(jīng)驗(yàn),探索解決轉(zhuǎn)型困境的法律路徑。本文的研究思路如下: 首先,對(duì)資源型城市發(fā)展的相關(guān)概念進(jìn)行厘清,闡述了資源型城市發(fā)展的基本特征和發(fā)展階段等基本內(nèi)容和理論,并運(yùn)用法律、經(jīng)濟(jì)學(xué)的理論工具分析西部資源型城市轉(zhuǎn)型對(duì)法律和政策的依賴(lài)性,夯實(shí)本課題的理論基石。 其次,通過(guò)對(duì)西部資源型城市的實(shí)地調(diào)研,確立了本文研究的落腳點(diǎn)——構(gòu)建西部資源型城市轉(zhuǎn)型的法律保護(hù)和政策支持體系。通過(guò)調(diào)研對(duì)西部資源型城市的特殊戰(zhàn)略地位、轉(zhuǎn)型所面臨困境的成因有了更深層次的理解,運(yùn)用比較分析的方法將國(guó)內(nèi)外資源型城市轉(zhuǎn)型的典型經(jīng)驗(yàn)予以總結(jié),作為制度構(gòu)建的實(shí)證支撐。 最后,在理論闡述和實(shí)證分析的基礎(chǔ)上,提出構(gòu)建西部資源型城市轉(zhuǎn)型的法律保護(hù)和政策支持體系的思路:在可持續(xù)發(fā)展的理念下,我國(guó)西部資源型城市應(yīng)選擇政府統(tǒng)籌法制先行的轉(zhuǎn)型模式,將政府視為推動(dòng)西部資源型城市轉(zhuǎn)型的主導(dǎo)力量,同時(shí)采取有效措施鼓勵(lì)公眾積極參與該社會(huì)系統(tǒng)工程,從而形成助推西部資源型城市轉(zhuǎn)型的合力;微觀層面上本文提出創(chuàng)新具體的環(huán)境法律制度,如轉(zhuǎn)型的專(zhuān)項(xiàng)基金制度,土地污染防治制度,資源開(kāi)發(fā)補(bǔ)償制度,綠色政績(jī)考核制度,環(huán)境保護(hù)問(wèn)責(zé)制度;政策層面上,本文主要是從資源產(chǎn)業(yè)援助政策和接續(xù)替代產(chǎn)業(yè)的鼓勵(lì)政策兩方面建議創(chuàng)造西部資源型城市寬松的政策支持環(huán)境。
[Abstract]:Resource-based cities are generally faced with the difficulties of low utilization of resources, serious environmental pollution and weak economic development. Therefore, the academic circles have proposed to adjust the industrial structure in order to promote the transformation of resource-based cities. This article takes the western resource-based city as the research object, from the legal angle of view, analyzes the formation reason of the western resource-based city transformation dilemma, through the empirical analysis of the domestic and foreign resource-based city transformation, draws lessons from its beneficial experience. Explore the legal path to solve the dilemma of transformation. The research ideas of this paper are as follows: firstly, the related concepts of resource-based city development are clarified, the basic characteristics and stages of resource-based city development are expounded, and the law is applied. The theoretical tools of economics analyze the dependence of the transformation of western resource-based cities on laws and policies, and consolidate the theoretical foundation of this topic. Secondly, through the field investigation of the resource-based cities in the west, the thesis establishes the foothold of this study-constructing the legal protection and policy support system for the transformation of resource-based cities in the west. Through the investigation and research on the special strategic position of the resource-based cities in the west, the causes of the difficulties faced by the transformation have been further understood, and the typical experience of the transformation of resource-based cities at home and abroad has been summarized by using the method of comparative analysis. As an empirical support for institutional construction. Finally, on the basis of theoretical analysis and empirical analysis, the author puts forward the idea of constructing the legal protection and policy support system for the transformation of resource-based cities in western China: under the concept of sustainable development, The resource-based cities in the west of China should choose the transformation mode of the government as a whole and the legal system first, regard the government as the leading force to promote the transformation of the resource-based cities in the west, and take effective measures to encourage the public to actively participate in the social system engineering. Thus forming the resultant force to promote the transformation of resource-based cities in the west; On the micro level, this paper proposes to innovate the specific environmental legal system, such as the special fund system of transformation, the land pollution prevention system, the resources development compensation system, the green performance appraisal system, the environmental protection accountability system; On the policy level, this paper proposes to create a relaxed policy support environment for resource-based cities in western China from the two aspects of resource industry assistance policy and alternative industry encouragement policy.
