【摘要】：當(dāng)前環(huán)境法學(xué)表象繁榮的背后隱藏著專業(yè)性不強(qiáng)的危機(jī),其根源在于較為落后的法律觀。在一些環(huán)境法理論中作為言說基礎(chǔ)和前提預(yù)設(shè)的"法"與作為現(xiàn)代法治基礎(chǔ)的"法"存在較大差異,具體表現(xiàn)為法律道德主義色彩濃厚、與科學(xué)規(guī)律界限不明、主體性缺失、孤立立法、與傳統(tǒng)法的關(guān)系失當(dāng)五個(gè)方面。法律觀偏失的環(huán)境法學(xué)研究在實(shí)踐中只起到思想啟蒙的作用,無助于環(huán)境法治的實(shí)現(xiàn)。要想獲得理論提升和實(shí)踐突破,環(huán)境法學(xué)必須對(duì)自己的核心任務(wù)和研究范圍作出準(zhǔn)確定位,牢牢把握法的本質(zhì)特征,加強(qiáng)本土化研究,尊重現(xiàn)行法,采取現(xiàn)實(shí)主義思維,實(shí)現(xiàn)向法學(xué)的回歸。
[Abstract]:At present, behind the appearance prosperity of environmental law, there is a crisis that is not professional, and its root lies in the relatively backward legal view. In some environmental law theories, there are great differences between "law" and "law", which are the presupposition of speech and premise, which are the basis of modern rule of law, which are manifested in the strong color of legal morality, unclear boundaries with scientific laws, and lack of subjectivity. The relationship between isolated legislation and traditional law is wrong in five aspects. The study of environmental law, which is partial to the legal view, only plays the role of ideological enlightenment in practice, and is not helpful to the realization of environmental rule of law. If we want to get a breakthrough in theory and practice, environmental law must make an accurate orientation to its core task and research scope, firmly grasp the essential characteristics of law, strengthen the study of localization, respect the current law, and adopt realistic thinking. To realize the return to law.
