【摘要】：對(duì)瑕疵擔(dān)保責(zé)任進(jìn)行清晰的闡釋,簡(jiǎn)要論述原生于歐美的EPR政策中生產(chǎn)者責(zé)任的落實(shí)條件及手段,并對(duì)應(yīng)分析我國(guó)的情況和所面臨的困境,以表明我國(guó)推行EPR政策宜更多地倚重于私法化保障手段。在此基礎(chǔ)上,對(duì)作為EPR政策落實(shí)手段的固體廢棄物瑕疵擔(dān)保責(zé)任進(jìn)行理論上的建構(gòu),依次從固體廢棄物瑕疵擔(dān)保責(zé)任的內(nèi)涵、權(quán)利義務(wù)主體、客體、內(nèi)容等方面加以分析。
[Abstract]:This paper gives a clear explanation of the liability for defective warranty, briefly discusses the conditions and means of implementing producer responsibility, which originated in the EPR policy of Europe and the United States, and analyses the situation and predicament of our country. In order to show that our country carries out EPR policy should rely more on the private law safeguard means. On this basis, the theoretical construction of the liability for the guarantee of defects of solid wastes, which is the means of implementing the EPR policy, is carried out, and the connotation, the subject, the object and the content of the liability for the guarantee of defects of solid wastes are analyzed in turn.
