【摘要】：科學(xué)技術(shù)的日益更新,經(jīng)濟(jì)的高速發(fā)展,消費(fèi)型社會(huì)的持續(xù)存在,導(dǎo)致了大量廢物,尤其是危險(xiǎn)廢物的產(chǎn)生。危險(xiǎn)廢物的污染防治已成為全球環(huán)境保護(hù)的熱點(diǎn)之一。 在危險(xiǎn)廢物污染防治過程中,各國(guó)均制訂了一系列配套的法律管理制度,主要包括:危險(xiǎn)廢物鑒別制度、分類管理制度、許可制度以及風(fēng)險(xiǎn)預(yù)防制度。 論文第一部分介紹了危險(xiǎn)廢物的內(nèi)涵、特征、管理理念以及配套的主要法律制度等基本理論。在后面的四部分中,分別針對(duì)危險(xiǎn)廢物鑒別制度、分類管理制度、許可制度和風(fēng)險(xiǎn)預(yù)防制度,將我國(guó)與其他發(fā)達(dá)國(guó)家的法律制度進(jìn)行了比較研究。根據(jù)我國(guó)法律制度存在的不足,通過比較分析的方法,重點(diǎn)研究了美國(guó)、歐盟的鑒別制度;美國(guó)的分類管理制度;美國(guó)的處理、貯存或處置危險(xiǎn)廢物許可制度、德國(guó)的危險(xiǎn)廢物許可制度、中國(guó)香港的危險(xiǎn)廢物集中處置特許經(jīng)營(yíng)制度;美國(guó)的超級(jí)基金計(jì)劃制度和環(huán)境污染責(zé)任保險(xiǎn)制度。在評(píng)析上述國(guó)家法律制度的基礎(chǔ)上,筆者總結(jié)了各國(guó)法律制度的共同點(diǎn)和特色之處,希冀結(jié)合我國(guó)的具體國(guó)情,為完善我國(guó)危險(xiǎn)廢物管理的法律制度提出修改建議,使危險(xiǎn)廢物管理工作更具系統(tǒng)化、科學(xué)性和可操作性。
[Abstract]:With the development of science and technology, the rapid development of economy and the persistence of consumer society, a large number of wastes, especially hazardous wastes, are produced. Pollution prevention and control of hazardous waste has become one of the hot spots in global environmental protection. In the process of hazardous waste pollution prevention and control, countries have formulated a series of supporting legal management systems, including: hazardous waste identification system, classified management system, licensing system and risk prevention system. The first part of the paper introduces the connotation, characteristics, management concept and supporting main legal system of hazardous waste. In the last four parts, the legal systems of China and other developed countries are compared with those of other developed countries in view of hazardous waste identification system, classified management system, licensing system and risk prevention system. According to the deficiency of our country's legal system, through the method of comparative analysis, this paper focuses on the identification system of the United States and the European Union, the classification management system of the United States, and the classification management system of the United States of America. The permit system for the treatment, storage or disposal of hazardous waste in the United States, the permit system for hazardous waste in Germany, the franchise system for the centralized disposal of hazardous waste in Hong Kong, the superfund scheme system and the liability insurance system for environmental pollution in the United States. On the basis of analyzing the legal systems of the above countries, the author sums up the common points and characteristics of the legal systems of various countries, and hopes to put forward some suggestions for the improvement of the legal system of hazardous waste management in China in the light of the specific conditions of our country. To make hazardous waste management more systematic, scientific and operational.
