【摘要】： 生產(chǎn)者延伸義務(wù)是環(huán)境法律法規(guī)賦予企業(yè)的新型義務(wù),其對于產(chǎn)品廢棄物的回收與處理有重要意義,有利于保護(hù)環(huán)境,提高資源利用效率。生產(chǎn)者延伸責(zé)任在未規(guī)定到法律中以前只是對生產(chǎn)者的一種道德約束,當(dāng)它逐步被國家立法確立為一系列環(huán)境法律義務(wù)時,才擁有了國家強制力。因此,本文從法律的視角出發(fā),把這一系列環(huán)境法律義務(wù)稱為生產(chǎn)者延伸義務(wù),而非沿用延伸責(zé)任的說法。在對該義務(wù)的涵義進(jìn)行界定后,系統(tǒng)地論述了生產(chǎn)者延伸義務(wù)的理論依據(jù)、義務(wù)內(nèi)容、相關(guān)輔助制度,并以該義務(wù)的理論依據(jù)為重點,對生產(chǎn)者延伸義務(wù)的基本問題進(jìn)行較為全面的分析和研究。
[Abstract]:Producer extension obligation is a new type of obligation given to enterprises by environmental laws and regulations. It is of great significance to the recovery and disposal of product wastes, and is beneficial to the protection of the environment and the improvement of resource utilization efficiency. The extended producer responsibility is only a kind of moral restriction to the producer before it is stipulated into the law. When it is gradually established as a series of environmental legal obligations by the national legislation, it has the national coercive power. Therefore, from the perspective of law, this article calls this series of environmental legal obligations as extended producer obligations, rather than using the term extended responsibility. After defining the meaning of the obligation, this paper systematically discusses the theoretical basis, the content of the obligation, the relevant auxiliary system, and focuses on the theoretical basis of the obligation. The basic issues of extended producer obligations are comprehensively analyzed and studied.
