【摘要】： 環(huán)境侵權(quán)救濟(jì)的經(jīng)濟(jì)保障制度,是指當(dāng)污染項(xiàng)目有導(dǎo)致環(huán)境損害發(fā)生的可能時(shí),環(huán)境利害關(guān)系人有權(quán)通過法定程序要求污染項(xiàng)目的業(yè)主提供經(jīng)濟(jì)上的保障措施,以保證日后遭受確切環(huán)境損害時(shí)能夠獲得及時(shí)充分的救濟(jì)。經(jīng)濟(jì)保障措施的形式多種多樣,包括環(huán)境損害救濟(jì)準(zhǔn)備金、第三方財(cái)務(wù)保證、物權(quán)擔(dān)保、環(huán)境責(zé)任保險(xiǎn)、環(huán)境基金等。 經(jīng)濟(jì)保障制度作為保障公眾環(huán)境權(quán)得以實(shí)現(xiàn)的有效形式和必然要求,是解決環(huán)境侵權(quán)救濟(jì)不足的關(guān)鍵環(huán)節(jié),是貫徹環(huán)境法預(yù)防為主原則、污染者付費(fèi)原則的重要體現(xiàn)和應(yīng)有措施,是提高公眾參與環(huán)境保護(hù)水平的有效途徑。經(jīng)濟(jì)保障制度在發(fā)達(dá)國家已經(jīng)得到普遍運(yùn)用,但其在我國的建設(shè)基本上還處于空白期,不僅作為經(jīng)濟(jì)保障制度重要組成部分的賠償準(zhǔn)備金、物權(quán)擔(dān)保、財(cái)務(wù)保證等鮮有提及,就連學(xué)界普遍關(guān)注的環(huán)境責(zé)任保險(xiǎn)、環(huán)境基金也缺乏足夠的立法支撐。 文章以對環(huán)境侵權(quán)相關(guān)基本法學(xué)范疇的研究為邏輯起點(diǎn),深度剖析了環(huán)境侵權(quán)、環(huán)境侵權(quán)救濟(jì)、環(huán)境侵權(quán)救濟(jì)的經(jīng)濟(jì)保障制度之內(nèi)涵,重點(diǎn)研究了經(jīng)濟(jì)保障制度存在的現(xiàn)實(shí)與理論根據(jù)、國際和國內(nèi)實(shí)踐,緊緊圍繞經(jīng)濟(jì)保障制度的模式選擇、切入點(diǎn)、可訴性、實(shí)體性要件、經(jīng)濟(jì)保障的止度等重點(diǎn)問題,提出了建立我國環(huán)境侵權(quán)救濟(jì)經(jīng)濟(jì)保障制度的立法建議。
[Abstract]:The economic security system for relief of environmental tort refers to the right of environmental stakeholders to require owners of polluting projects to provide economic safeguards through legal procedures when pollution projects are likely to cause environmental damage. In order to ensure that the exact environmental damage in the future will be able to receive timely and adequate relief. There are many forms of economic security measures, including environmental damage relief reserve, third party financial guarantee, real right guarantee, environmental liability insurance, environmental fund and so on. As an effective form and necessary requirement for the realization of public environmental rights, the economic security system is the key link to solve the shortage of environmental tort relief and the principle of environmental law prevention. The important embodiment and proper measures of polluter pays principle is an effective way to improve the level of public participation in environmental protection. The economic security system has been widely used in developed countries, but its construction in our country is basically still in a blank period, not only as an important part of the economic security system compensation reserve, security of interest, financial guarantee and other rarely mentioned. Even the environmental liability insurance that the academic circles are generally concerned about, the environmental fund also lacks sufficient legislative support. Based on the research on the basic legal category of environmental tort, this paper analyzes the connotation of the economic security system of environmental tort and environmental tort relief. Focusing on the reality and theoretical basis of the existence of economic security system, international and domestic practice, focusing on the choice of economic security system model, breakthrough point, justiciability, substantive requirements, the degree of economic security and other key issues. The legislative suggestion of establishing the economic security system of environmental tort relief in China is put forward.
