【摘要】： 自80年代初以來,我國政府就把環(huán)境保護(hù)作為一項(xiàng)基本國策。環(huán)境法制建設(shè)在環(huán)境保護(hù)工作中起到了十分重要的作用。但由于環(huán)境法制建設(shè)起步較晚,重視不夠,以及環(huán)境法律體系更新緩慢,日益顯現(xiàn)出其不適應(yīng)當(dāng)前我國生態(tài)文明建設(shè)需要之一面。 近幾年來,我們國家日益突出的環(huán)境問題,已不僅僅是社會(huì)發(fā)展某一環(huán)節(jié)問題,而是關(guān)系全局的重大現(xiàn)實(shí)問題。而在市場(chǎng)經(jīng)濟(jì)日益成熟,法制建設(shè)逐步完善的今天,把環(huán)境保護(hù)納入法制建設(shè)進(jìn)程,建立健全環(huán)境法制體系建設(shè),以法治為主進(jìn)行綜合治理,應(yīng)該說是解決當(dāng)前環(huán)境問題的最佳方案。尤其是在胡錦濤同志在黨的十七大報(bào)告中將“建設(shè)生態(tài)文明”明確定義為我國在2020年實(shí)現(xiàn)全面建設(shè)小康目標(biāo)的新要求之一后,完善環(huán)境法制建設(shè)顯得更加迫切。 早在1999年,時(shí)任國務(wù)院副總理的溫家寶同志就提出“21世紀(jì)將是一個(gè)生態(tài)文明的世紀(jì)”的論斷。5年前,在黨的十六大報(bào)告中,“可持續(xù)發(fā)展能力不斷增強(qiáng),生態(tài)環(huán)境得到改善,資源利用效率顯著提高,促進(jìn)人與自然的和諧,推動(dòng)整個(gè)社會(huì)走上生產(chǎn)發(fā)展、生活富裕、生態(tài)良好的文明發(fā)展道路”被定義為全面建設(shè)小康社會(huì)的目標(biāo)之一。而今,生態(tài)文明的提出,不僅豐富了馬克思主義生態(tài)文明的理論內(nèi)涵,使這一目標(biāo)在理論上得到了全面升華,也為人們重新審視人與自然的關(guān)系,反思中國生態(tài)環(huán)境法制建設(shè)存在的問題,完善環(huán)境法制建設(shè)提供了創(chuàng)新的啟迪和契機(jī)。 本文試就生態(tài)文明進(jìn)程中的我國環(huán)境法制建設(shè)問題作一下探討.從生態(tài)文明思想確立的過程入手,從環(huán)境法律體系現(xiàn)狀出發(fā),結(jié)合當(dāng)前我國經(jīng)濟(jì)社會(huì)發(fā)展的具體情況及環(huán)境保護(hù)的現(xiàn)狀,探索出當(dāng)前我國環(huán)境法制建設(shè)存在的問題以及解決方法,在生態(tài)文明思想的指導(dǎo)之下對(duì)我國環(huán)境法制建設(shè)的進(jìn)程做出若干思考。
[Abstract]:Since the beginning of 1980's, our government has regarded environmental protection as a basic national policy. The construction of environmental legal system plays a very important role in environmental protection. However, due to the late start of the environmental legal system, insufficient attention, and the slow renewal of the environmental legal system, it is increasingly showing that it does not meet the needs of the current construction of ecological civilization in China. In recent years, the increasingly prominent environmental problems in our country are not only a matter of social development, but also a major practical problem related to the overall situation. Today, when the market economy is increasingly mature and the legal system is gradually improving, environmental protection is brought into the process of legal construction, a sound environmental legal system is established, and the rule of law is the main means for comprehensive management. It should be said to be the best solution to the current environmental problems. Especially after Comrade Hu Jintao defined "building ecological civilization" as one of the new requirements to realize the goal of building a well-off society in 2020, it is more urgent to perfect the environmental legal system construction in the report of the 17th National Congress of the Communist Party of China. As early as 1999, Comrade Wen Jiabao, then vice premier of the State Council, argued that "the 21st century will be a century of ecological civilization." five years ago, in the report of the 16th National Congress of the Party, "the ability of sustainable development is constantly increasing." The ecological environment has been improved, the efficiency of the use of resources has increased significantly, the harmony between man and nature has been promoted, and the whole society has been promoted to develop in production and to live in a rich life. The road of civilization development with good ecology is defined as one of the goals of building a well-off society in an all-round way. Now, the proposal of ecological civilization not only enriches the theoretical connotation of Marxist ecological civilization, but also makes this goal sublimate in theory, and it also gives people a new look at the relationship between man and nature. Reflecting on the problems existing in the legal construction of ecological environment in China and perfecting the construction of the legal system of the environment, it provides an innovative inspiration and opportunity. This paper discusses the construction of environmental legal system in the process of ecological civilization. Starting from the process of establishing the thought of ecological civilization, starting from the current situation of the environmental legal system, combining the specific situation of the economic and social development of our country and the present situation of environmental protection, This paper explores the existing problems and solutions in the construction of environmental legal system in China, and makes some reflections on the process of the construction of environmental legal system under the guidance of the thought of ecological civilization.
