【摘要】： 隨著我國海洋石油天然氣資源開發(fā)產(chǎn)業(yè)的發(fā)展,海洋石油天然氣管道的保護(hù)問題提上了國家立法議程。本文以我國海洋石油天然氣管道保護(hù)的立法問題研究為核心,首先梳理并闡述了我國海洋石油天然氣管道的基本情況和保護(hù)現(xiàn)狀,接著整理并分析了我國和部分管道發(fā)達(dá)國家的海洋石油天然氣管道保護(hù)相關(guān)的法規(guī),在此基礎(chǔ)上,筆者提出了我國海洋石油天然氣管道保護(hù)立法應(yīng)當(dāng)解決的幾個重大問題及相應(yīng)的立法建議。本文的創(chuàng)新之處在于,在充分調(diào)查分析我國海洋石油天然氣管道保護(hù)現(xiàn)狀和立法訴求的基礎(chǔ)上,通過分析我國及其他國家相關(guān)的法律制度設(shè)計和立法經(jīng)驗,提出我國海洋石油天然氣管道保護(hù)需要通過立法重點解決的幾個問題,并從法律制度設(shè)計和具體法條建議方面進(jìn)行了深入探討,對于我國海洋石油天然氣管道保護(hù)的法制建設(shè)具有理論價值和實踐意義。
[Abstract]:With the development of China's offshore oil and gas resources exploitation industry, the protection of offshore oil and gas pipelines has been put on the national legislative agenda. This paper focuses on the legislative research on the protection of offshore oil and gas pipelines in China. Firstly, the basic situation and current situation of protection of offshore oil and gas pipelines in China are summarized and expounded. Then, the related laws and regulations on the protection of offshore oil and gas pipelines in China and some developed countries of pipelines are sorted out and analyzed, and on this basis, The author puts forward several important problems that should be solved in China's offshore oil and gas pipeline protection legislation and corresponding legislative suggestions. The innovation of this paper is that, on the basis of full investigation and analysis of the status quo and legislative demands of China's offshore oil and gas pipeline protection, through the analysis of the relevant legal system design and legislative experience of our country and other countries, This paper puts forward several problems that need to be solved by legislation for the protection of offshore oil and gas pipelines in China, and makes a thorough discussion on the design of legal system and specific legal proposals. It is of theoretical value and practical significance for the legal construction of offshore oil and gas pipeline protection in China.
