中國(guó)林權(quán)制度變遷研究

【摘要】:從發(fā)展觀(guān)的變遷出發(fā),深入探討國(guó)際上普遍認(rèn)可的可持續(xù)發(fā)展理論,可持續(xù)發(fā)展理論為中國(guó)林權(quán)制度的發(fā)展提供了方向,為林業(yè)的持續(xù)發(fā)展提供了理論支持。以可持續(xù)發(fā)展理論、產(chǎn)權(quán)理論、制度變遷理論為基礎(chǔ),深層次發(fā)掘林權(quán)制度的理論內(nèi)涵,揭示林權(quán)制度安排的本質(zhì)淵源,豐富中國(guó)林權(quán)制度變遷理論。 林業(yè)的可持續(xù)發(fā)展是中國(guó)經(jīng)濟(jì)社會(huì)可持續(xù)發(fā)展戰(zhàn)略中的重要組成部分,實(shí)踐與理論證明,林權(quán)制度的合理安排對(duì)林業(yè)的可持續(xù)發(fā)展起著關(guān)鍵和核心的作用。正確看待林權(quán)制度變遷的各個(gè)歷史階段對(duì)當(dāng)前林權(quán)制度的安排有著很好的借鑒作用,因?yàn)?任何政策、法規(guī)都不是突如其來(lái)的,政策之間具有延續(xù)性與承繼性,林權(quán)制度也不例外;仡櫫謾(quán)制度的變遷史,不難發(fā)現(xiàn)林權(quán)制度的變遷都是為了更好地保護(hù)和實(shí)現(xiàn)其經(jīng)濟(jì)價(jià)值,滿(mǎn)足利益相關(guān)者的訴求,這就忽視了林業(yè)的其他效益。對(duì)各個(gè)階段林權(quán)制度進(jìn)行客觀(guān)評(píng)析后,發(fā)現(xiàn)社會(huì)各界對(duì)林權(quán)制度變遷中的林業(yè)“三定”階段存在一些誤解,普遍認(rèn)為林業(yè)“三定”違背了林權(quán)制度改革的初衷,沒(méi)有順利實(shí)施與完成,造成了不好的政策后果,以林業(yè)“三定”作為重點(diǎn)對(duì)林權(quán)制度改革進(jìn)行客觀(guān)公正地評(píng)析,找出各個(gè)階段林權(quán)制度改革的可持續(xù)性以及不合理性,林權(quán)制度改革經(jīng)過(guò)曲折的發(fā)展終于找到林業(yè)發(fā)展的正確路徑。并得出結(jié)論:一、林權(quán)制度的變遷要隨著社會(huì)的發(fā)展而發(fā)展,與社會(huì)發(fā)展相和諧,不斷適應(yīng)社會(huì)發(fā)展的新變化和新要求。二、林業(yè)“三定”的歷史地位不容忽視,林業(yè)“三定”各項(xiàng)政策順利完成后卻沒(méi)有同社會(huì)的發(fā)展同步改進(jìn),也沒(méi)有與中國(guó)特殊的林情相適應(yīng),才會(huì)出現(xiàn)政策同林業(yè)實(shí)際經(jīng)營(yíng)的矛盾,讓社會(huì)各界產(chǎn)生誤解,不能正確的對(duì)待它,我們要汲取經(jīng)驗(yàn)摒棄教訓(xùn)。三、正確看待林權(quán)制度變遷中的困難和失敗,任何制度的產(chǎn)生都不是一帆風(fēng)順的,在各種因素的制約下,林權(quán)制度改革必定會(huì)伴隨著曲折而成長(zhǎng),我們應(yīng)該正視問(wèn)題,并解決這些問(wèn)題,而不是否定它,就像看待林業(yè)“三定”一樣。 在上述結(jié)論的基礎(chǔ)上,總結(jié)林權(quán)制度改革的成效并提出了些許建議,以可持續(xù)發(fā)展理念帶動(dòng)林業(yè)的持續(xù)發(fā)展,林權(quán)制度改革的道路雖然還很漫長(zhǎng),可能還會(huì)遇到很多挫折,但隨著林權(quán)制度改革的繼續(xù)深化,林業(yè)建設(shè)的可持續(xù)發(fā)展必將修成正果,我們對(duì)林權(quán)制度改革充滿(mǎn)期盼,充滿(mǎn)信心。
[Abstract]:Based on the change of the concept of development, this paper probes into the theory of sustainable development which is generally accepted in the world. The theory of sustainable development provides a direction for the development of Chinese forest tenure system and provides theoretical support for the sustainable development of forestry. Based on the theory of sustainable development, the theory of property right and the theory of institutional change, this paper explores the theoretical connotation of the forest right system, reveals the essential origin of the arrangement of the forest right system, and enriches the theory of the change of the forest right system in China. The sustainable development of forestry is an important part of the sustainable development strategy of Chinese economy and society. The practice and theory prove that the rational arrangement of forest right system plays a key and core role in the sustainable development of forestry. The correct treatment of the historical stages of the change of forest tenure system has a good reference to the arrangement of the current forest tenure system, because no policy or regulation comes out of the blue, and there is continuity and inheritance between the policies. Forest right system is no exception. It is not difficult to find that the change of forest tenure system is to better protect and realize its economic value and satisfy the demands of stakeholders, which ignores the other benefits of forestry. After an objective analysis of the forest property right system in various stages, it is found that there are some misunderstandings about the forestry "three definite" stage in the forest tenure system change, and it is generally believed that the forestry "three definite" system violates the original intention of the forest property right system reform. The failure of the successful implementation and completion of the forest property right system has resulted in bad policy consequences. Taking the forestry "three determinations" as the focus, the paper evaluates the forest tenure system reform objectively and impartially, and finds out the sustainability and irrationality of the forest property right system reform in each stage. The reform of forest property right system has finally found the correct path of forestry development after tortuous development. The main conclusions are as follows: first, the change of forest right system should develop with the development of society, be harmonious with social development, and adapt to the new changes and requirements of social development. Second, the historical status of the forestry "three determinations" cannot be ignored. After the successful completion of the forestry "three decisions" policies, however, they have not improved synchronously with the development of society, nor have they been adapted to the special forest conditions of China. Only then will there appear the contradiction between the policy and the actual management of forestry, which will lead to misunderstandings in all walks of life of the society and will not treat it correctly, so we should learn from the experience and abandon the lessons. Third, correctly look at the difficulties and failures in the change of forest property right system, and the emergence of any system is not smooth. Under the restriction of various factors, forest right system reform will surely grow with twists and turns. We should face the problem squarely. And solve these problems, rather than negate it, just like the forestry "three certainty." On the basis of the above conclusions, this paper summarizes the effect of forest tenure system reform and puts forward some suggestions. The sustainable development of forestry is promoted by the concept of sustainable development. Although the road of forest tenure system reform is still long, it may encounter many setbacks. However, with the deepening of the reform of forest property right system, the sustainable development of forestry construction will surely become a positive result. We are full of expectation and confidence in the reform of forest property right system.
