【摘要】：隨著我國經(jīng)濟(jì)的快速發(fā)展,人類對(duì)環(huán)境與資源的過度開發(fā)利用造成了人與環(huán)境關(guān)系的惡化和資源的緊張,而對(duì)水資源的污染破壞尤其是對(duì)飲用水源的污染破壞已經(jīng)嚴(yán)重制約了一些地方的發(fā)展。而在我國農(nóng)村地區(qū),因?yàn)樾l(wèi)生與設(shè)備情況的落后,使得飲用水源出現(xiàn)了多種問題,水質(zhì)狀況惡化,進(jìn)而引起了一些與飲用水有關(guān)的疾病的發(fā)生,影響了農(nóng)村人口的身體健康和生命安全。雖然,我國在農(nóng)村飲用水源保護(hù)立法上已經(jīng)取得了一些成果,但是也存在很多不足,因此,應(yīng)該加強(qiáng)對(duì)農(nóng)村飲用水源的保護(hù)。 而造成以上缺陷的主要原因是農(nóng)村飲用水源的立法指導(dǎo)思想失誤,缺乏制度保障,立法缺乏理論支撐,立法缺乏科學(xué)技術(shù)支持以及立法過程不科學(xué)。有鑒于此,在我國農(nóng)村飲用水源保護(hù)立法的完善過程中,應(yīng)將科學(xué)發(fā)展觀確立為我國農(nóng)村飲用水源的立法指導(dǎo)思想,同時(shí),還要確立農(nóng)村飲用水源保護(hù)立法的原則,如優(yōu)先保護(hù)原則、預(yù)防原則、安全原則、公平原則和國家扶持原則。并以諸原則為指導(dǎo),完善我國農(nóng)村飲用水源保護(hù)的法律體系,在借鑒國外立法經(jīng)驗(yàn)的基礎(chǔ)上,對(duì)我國農(nóng)村飲用水源水質(zhì)監(jiān)管制度,飲用水源保護(hù)區(qū)制度,飲用水源應(yīng)急制度等制度上加以完善,同時(shí),還要建立科學(xué)合理的農(nóng)村飲用水源保護(hù)法律責(zé)任體系,這樣才能保證我國農(nóng)村飲用水源的安全。
[Abstract]:With the rapid development of our country's economy, the over-exploitation and utilization of the environment and resources have caused the deterioration of the relationship between human beings and the environment and the tension of the resources. However, pollution damage to water resources, especially to drinking water sources, has seriously restricted the development of some places. In rural areas of our country, because of the backwardness of sanitation and equipment, there are many problems in drinking water sources, and the water quality is deteriorating, which in turn leads to the occurrence of some diseases related to drinking water. It affects the health and safety of the rural population. Although our country has made some achievements in the legislation of rural drinking water source protection, there are still many shortcomings. Therefore, we should strengthen the protection of rural drinking water source. The main reasons for the above defects are the failure of legislation guiding ideology, the lack of system guarantee, the lack of theoretical support, the lack of scientific and technological support and the unscientific legislative process. In view of this, in the process of perfecting the legislation of rural drinking water source protection, the scientific development view should be established as the guiding ideology of rural drinking water source legislation in our country, at the same time, the principle of rural drinking water source protection legislation should be established. Such as priority protection principle, prevention principle, safety principle, fair principle and state support principle. Under the guidance of various principles, this paper consummates the legal system of drinking water source protection in rural areas of our country. On the basis of drawing lessons from foreign legislative experience, the supervision system of drinking water quality and the system of drinking water source protection area in rural areas of China are introduced. At the same time, it is necessary to establish a scientific and reasonable legal responsibility system for the protection of drinking water resources in rural areas, so as to ensure the safety of drinking water sources in rural areas.
