【摘要】： 傳統(tǒng)的經(jīng)濟(jì)發(fā)展模式呈現(xiàn)一種“資源利用→污染排放→環(huán)境治理”的直線形,經(jīng)濟(jì)的發(fā)展伴隨的是環(huán)境的破壞與污染的加劇。相對于這種“線形”發(fā)展邏輯,“循環(huán)經(jīng)濟(jì)”模式的核心在于通過物質(zhì)生產(chǎn)與環(huán)境保護(hù)的融合來實現(xiàn)高速增長的經(jīng)濟(jì)與“良性”生態(tài)環(huán)境的共生共榮。因而在“循環(huán)經(jīng)濟(jì)”模式下,物質(zhì)資源的消耗與環(huán)境的良好維護(hù)實質(zhì)上具有同等的重要性。因此,當(dāng)前在我國發(fā)展循環(huán)經(jīng)濟(jì)的根本問題是如何將原本孤立的環(huán)境保護(hù)法律制度深刻地融入到“循環(huán)經(jīng)濟(jì)”中去,即如何以循環(huán)經(jīng)濟(jì)為基本立法理念來構(gòu)建環(huán)境保護(hù)體系。 當(dāng)前提出“循環(huán)經(jīng)濟(jì)”框架下環(huán)境立法的重要意義包括三個方面:以循環(huán)經(jīng)濟(jì)為理念進(jìn)行環(huán)境立法可以保障我國可持續(xù)發(fā)展戰(zhàn)略的順利實現(xiàn);以循環(huán)經(jīng)濟(jì)為核心進(jìn)行環(huán)境立法可以促進(jìn)我國經(jīng)濟(jì)突破“發(fā)展瓶頸”;以循環(huán)經(jīng)濟(jì)理念為核心進(jìn)行環(huán)境立法可以加快西部經(jīng)濟(jì)發(fā)展,縮小東西部差距。 在此重要意義的基礎(chǔ)上,需要對西方主要發(fā)達(dá)國家以及我國部分地區(qū)循環(huán)經(jīng)濟(jì)立法現(xiàn)狀進(jìn)行考察,并借鑒國內(nèi)外循環(huán)經(jīng)濟(jì)立法的先進(jìn)之處來確定新疆循環(huán)經(jīng)濟(jì)立法的基本思路。通過對新疆循環(huán)經(jīng)濟(jì)立法進(jìn)行理論上的完善及制度上的建構(gòu),提出要發(fā)展新疆循環(huán)經(jīng)濟(jì)立法必須完善新疆循環(huán)經(jīng)濟(jì)立法的指導(dǎo)思想、立法的原則以及保障體系;在理論完善的基礎(chǔ)上最后提出需要制訂《新疆循環(huán)經(jīng)濟(jì)促進(jìn)條例》來推動新疆循環(huán)經(jīng)濟(jì)的發(fā)展。
[Abstract]:The traditional mode of economic development presents a linear pattern of "pollution discharge from resource utilization and environmental control", and the economic development is accompanied by environmental destruction and pollution intensification. Compared with this kind of "linear" development logic, the core of "circular economy" mode is to realize the symbiosis and co-prosperity of high growth economy and "benign" ecological environment through the integration of material production and environmental protection. Therefore, in the mode of circular economy, the consumption of material resources and the good maintenance of the environment are of equal importance in essence. Therefore, the fundamental problem of developing circular economy in our country is how to deeply integrate the original isolated legal system of environmental protection into the "circular economy", that is, how to construct the environmental protection system with circular economy as the basic legislative concept. The significance of environmental legislation under the framework of "circular economy" is put forward at present in three aspects: environmental legislation based on the concept of circular economy can guarantee the smooth realization of sustainable development strategy of our country; Environmental legislation with circular economy as the core can promote our economy to break through the "development bottleneck", and environmental legislation with circular economy as the core can speed up the economic development of the western region and narrow the gap between the east and the west. On the basis of this significance, it is necessary to investigate the current situation of circular economy legislation in some western developed countries and parts of China, and draw lessons from the advanced aspects of circular economy legislation at home and abroad to determine the basic ideas of circular economy legislation in Xinjiang. Through the theoretical perfection and the system construction of the circular economy legislation in Xinjiang, the author puts forward that the guiding ideology, the principle and the guarantee system of the circular economy legislation must be perfected in order to develop the circular economy legislation in Xinjiang. On the basis of the perfect theory, it is put forward that it is necessary to formulate the regulations of promoting Circular economy in Xinjiang to promote the development of circular economy in Xinjiang.
