社會源廢棄物的損害復(fù)合性及其法律控制研究

【摘要】：社會源廢棄物數(shù)量激增所帶來的環(huán)境問題隨著城市化、工業(yè)化的發(fā)展而愈發(fā)嚴(yán)重。社會源廢棄物的復(fù)合性——尤其是其損害模式的復(fù)合性加劇了社會源廢棄物的復(fù)雜性,是至今仍未有專門規(guī)制社會源廢棄物污染問題的法律出現(xiàn)的原因之一。就社會源廢棄物的法律控制而言,對其進(jìn)行研究勢必要圍繞其獨(dú)特的損害模式展開,而其損害模式的復(fù)合性具體體現(xiàn)在其"固—液—?dú)?多相損害模式以及"物—化—生"多元損害機(jī)理下的復(fù)合性損害。研究旨在以社會源廢棄物復(fù)合性危害模式為切入點(diǎn)來探討社會源廢棄物治理的相關(guān)立法規(guī)范,主要從"社會源廢棄物"之精準(zhǔn)化定義、責(zé)任主體的范圍、危害發(fā)生后的治理標(biāo)準(zhǔn)等方面展開,并針對現(xiàn)存問題給出了相應(yīng)的法律控制層面的建議。
[Abstract]:The environmental problems caused by the increasing number of social sources of waste are becoming more and more serious with the urbanization and the development of industrialization. The complex nature of the waste of social sources, especially the compound of its damage model, has aggravated the complexity of the waste of social sources. It is the original law of the legal emergence of the pollution problem of social sources. One of the reasons is that in terms of legal control of social source waste, it is necessary to carry out research on its unique pattern of damage, and the compound of its damage model is embodied in the complex damage of "solid liquid gas" multiphase damage model and "physical and chemical life" multiple damage mechanism. The model of harmfulness is the breakthrough point to discuss the relevant legislative norms of waste management of social sources, mainly from the precise definition of "social source waste", the scope of the main body of responsibility, the standard of harnessing after the occurrence of harm, and the corresponding suggestions on the level of law control in view of the existing problems.
