【摘要】：隨著我國(guó)生產(chǎn)力的發(fā)展,而由此所帶來(lái)的環(huán)境影響也越來(lái)越受到人們的關(guān)注,對(duì)于保護(hù)生態(tài)環(huán)境的呼聲日益高漲,那么,環(huán)境行政組織作為環(huán)境保護(hù)的主體也越來(lái)越受到重視,“環(huán)境行政組織”是指國(guó)家為了履行環(huán)境行政職能,依據(jù)特定的環(huán)境行政原則,以環(huán)境保護(hù)為目標(biāo)而建立起來(lái)的具有特定結(jié)構(gòu)和功能的機(jī)構(gòu)體系。對(duì)于環(huán)境行政組織的研究不僅有利于提高環(huán)境行政質(zhì)量并改善環(huán)境狀況,而且更有利于保護(hù)環(huán)境行政相對(duì)人的合法權(quán)益。 針對(duì)環(huán)境行政組織的研究對(duì)于環(huán)境行政權(quán)力的配置有著非常重要的意義,只有將環(huán)境行政組織的職權(quán)、職責(zé)、人員編制等要素合理的分配,才能使環(huán)境行政更及時(shí)、更有效,然而,單純的談環(huán)境行政組織的現(xiàn)狀還是遠(yuǎn)遠(yuǎn)不夠的,一方面公民環(huán)境權(quán)利意識(shí)不斷提高,另一方面環(huán)境執(zhí)法急待加強(qiáng),而環(huán)境行政組織體制自身卻難以適應(yīng),改革需要深化,要建立完備而高效的環(huán)境行政組織必須有相應(yīng)的法律作為依據(jù),環(huán)境行政組織法制建設(shè)需要進(jìn)一步跟進(jìn)。因此,為了提升環(huán)境保護(hù)的質(zhì)量,充分保障公民環(huán)境權(quán),從而建設(shè)生態(tài)政府,選擇走環(huán)境行政組織體制法制化的道路是必然的。
[Abstract]:With the development of productive forces in our country, the environmental impact brought by it has been paid more and more attention to, and the voice of protecting the ecological environment is rising day by day. Therefore, as the main body of environmental protection, the environmental administrative organization has been paid more and more attention to. "Environmental Administrative Organization" refers to the institutional system with specific structure and function established by the state in order to perform the functions of environmental administration, according to the specific environmental administrative principles and with the goal of environmental protection. The study of environmental administrative organization is not only conducive to improving the quality of environmental administration and improving the environmental situation, but also conducive to the protection of the legitimate rights and interests of the environmental administrative counterpart. The research on environmental administrative organization is of great significance to the allocation of environmental administrative power. Only by reasonably distributing the powers, duties and staffing of the environmental administrative organization, can environmental administration be more timely and effective. However, it is far from enough to simply talk about the current situation of environmental administrative organization. On the one hand, citizens' awareness of environmental rights is constantly improving, on the other hand, environmental law enforcement needs to be strengthened urgently, but the environmental administrative organization system itself is difficult to adapt to, and the reform needs to be deepened. In order to establish a complete and efficient environmental administrative organization, it is necessary to have the corresponding law as the basis, and the legal system construction of the environmental administrative organization needs to be followed up further. Therefore, in order to improve the quality of environmental protection, fully protect citizens' environmental rights and thus build ecological government, it is inevitable to take the road of legalization of environmental administrative organization system.
