陜西省礦業(yè)循環(huán)經(jīng)濟發(fā)展現(xiàn)狀及立法對策研究

【摘要】： 陜西省礦產(chǎn)資源儲量豐富,礦業(yè)經(jīng)濟發(fā)展迅速,潛力巨大。對陜西省礦業(yè)循環(huán)經(jīng)濟的發(fā)展模式及其立法對策進行深入研究,有利于加快陜西省由礦業(yè)大省向礦業(yè)強省轉變,并對促進陜西省經(jīng)濟社會的可持續(xù)發(fā)展具有十分重大的現(xiàn)實意義。 礦業(yè)循環(huán)經(jīng)濟與傳統(tǒng)的礦業(yè)經(jīng)濟有著本質(zhì)區(qū)別,它是指地球上的礦產(chǎn)及礦產(chǎn)品遵循礦產(chǎn)物質(zhì)的自身特征和自然生態(tài)規(guī)律,按照勘查、采選冶生產(chǎn)、深加工、消費等過程,構成一個閉環(huán)物質(zhì)流動系統(tǒng),與之依存的能量流、信息流等進行內(nèi)在疊加,達到與全球環(huán)境、社會進步等和諧發(fā)展的一個經(jīng)濟系統(tǒng),其核心是礦產(chǎn)資源的綜合開發(fā)利用。陜西省礦業(yè)經(jīng)濟的發(fā)展,走的仍是一條不能循環(huán)、粗放經(jīng)營的老路,嚴重阻礙了礦業(yè)經(jīng)濟的持續(xù)發(fā)展。當務之急,應該轉變礦業(yè)經(jīng)濟的發(fā)展模式,以科學發(fā)展觀為指導,全面貫徹可持續(xù)發(fā)展思想,加快制定相關法律法規(guī),以期促進陜西省礦業(yè)經(jīng)濟的全面、協(xié)調(diào)發(fā)展,最終達到在礦業(yè)開發(fā)領域全面推行循環(huán)經(jīng)濟的目的。 本文對礦業(yè)循環(huán)經(jīng)濟做了系統(tǒng)性的闡述,指出了陜西省礦業(yè)經(jīng)濟發(fā)展的現(xiàn)狀及存在的問題,對陜西省發(fā)展礦業(yè)循環(huán)經(jīng)濟的稟賦進行了分析,并探討了陜西省礦業(yè)循環(huán)經(jīng)濟的發(fā)展模式。陜西省礦業(yè)循環(huán)經(jīng)濟的發(fā)展,需要社會各個方面的配合,尤其需要通過完善立法來對其提供相關保障。以此為出發(fā)點,本文分析借鑒了國外循環(huán)經(jīng)濟立法的先進經(jīng)驗,進一步提出了建立陜西省礦業(yè)循環(huán)經(jīng)濟法律體系的基本原則、指導思想、立法對策等。陜西省必須從中央和地方兩個層面優(yōu)化管理,修訂、完善現(xiàn)有立法、制定新的法律法規(guī),以保障陜西省礦業(yè)循環(huán)經(jīng)濟的可持續(xù)發(fā)展。
[Abstract]:Shaanxi Province is rich in mineral resources, mining economy is developing rapidly, the potential is huge. A thorough study on the development mode and legislative countermeasures of mining circular economy in Shaanxi Province is helpful to accelerate the transformation from a large mining province to a strong mining province in Shaanxi Province. It is of great practical significance to promote the sustainable development of economy and society in Shaanxi Province. Mining circular economy is essentially different from traditional mining economy. It means that minerals and minerals on the earth follow their own characteristics and natural ecological laws, in accordance with the processes of exploration, mining, processing and production, deep processing and consumption, etc. A closed loop material flow system with which the energy flow and information flow are superimposed to achieve a harmonious development with the global environment and social progress is the core of which is the comprehensive exploitation and utilization of mineral resources. With the development of mining economy in Shaanxi Province, it is still an old road which can not be recycled and operated extensively, which seriously hinders the sustainable development of mining economy. The urgent task is to change the development mode of mining economy, take the scientific development view as the guide, carry out the thought of sustainable development in an all-round way, speed up the formulation of relevant laws and regulations, in order to promote the comprehensive and coordinated development of the mining economy in Shaanxi Province. Finally, the goal of promoting circular economy in the field of mining development is achieved. This paper systematically expounds the circular economy of mining industry, points out the present situation and existing problems of the development of mining economy in Shaanxi Province, and analyzes the endowment of the development of circular economy of mining industry in Shaanxi Province. The development model of mining circular economy in Shaanxi Province is also discussed. The development of mining circular economy in Shaanxi Province needs the cooperation of all aspects of society, especially through the improvement of legislation to provide it with relevant protection. Taking this as the starting point, this paper analyzes and draws lessons from the advanced experiences of foreign countries in the legislation of circular economy, and further puts forward the basic principles, guiding ideology and legislative countermeasures of establishing the legal system of mining circular economy in Shaanxi Province. In order to ensure the sustainable development of Shaanxi mining circular economy, Shaanxi Province must optimize management, revise and perfect existing legislation and formulate new laws and regulations from the central and local levels.
