【摘要】： 當(dāng)前,全球范圍內(nèi)不斷出現(xiàn)各種環(huán)境污染問題,其中,日益嚴(yán)峻的噪聲污染問題已逐漸成為全社會關(guān)注的一個(gè)重要環(huán)境問題。對噪聲污染的研究始于十七世紀(jì),二十世紀(jì)五十年代以后,噪聲被公認(rèn)為是一種嚴(yán)重的環(huán)境污染。近年來,噪聲污染已經(jīng)和大氣污染、水污染以及固體廢物污染一起被認(rèn)為是當(dāng)今社會的四大污染公害,給人類發(fā)展帶來了不利影響。目前人們在追求高質(zhì)量的物質(zhì)生活和精神享受的同時(shí),對聲環(huán)境的要求也越來越高,環(huán)境噪聲污染問題亟待解決。本文立足于國家經(jīng)濟(jì)社會可持續(xù)發(fā)展的大背景,借鑒法學(xué)、環(huán)境保護(hù)法學(xué)、生態(tài)經(jīng)濟(jì)學(xué)、環(huán)境科學(xué)等相關(guān)學(xué)科的理論,運(yùn)用文獻(xiàn)分析法、實(shí)證分析法、比較分析法等研究方法,并以法律為主線,對環(huán)境噪聲污染防治問題進(jìn)行了探討。 文章主要分為五個(gè)部分:第一部分為緒論部分,主要概述了課題背景、國內(nèi)外研究現(xiàn)狀、研究的目的及意義、研究的主要內(nèi)容和方法等。第二部分主要介紹了環(huán)境噪聲的一些基本問題,對環(huán)境噪聲以及環(huán)境噪聲污染進(jìn)行了概念界定,并在界定相關(guān)概念的基礎(chǔ)上,介紹了環(huán)境噪聲污染的特點(diǎn)和危害。第三部分首先綜述了我國環(huán)境噪聲污染防治立法現(xiàn)狀。介紹了各級人民政府主要職責(zé)、監(jiān)督管理體系、相關(guān)的法律制度以及各專項(xiàng)防治規(guī)定和法律責(zé)任的承擔(dān)。同時(shí)主要從立法、執(zhí)法、司法三個(gè)方面提出了當(dāng)前在法律層面上我國環(huán)境噪聲污染防治存在的諸多缺陷。第四部分通過對國外環(huán)境噪聲污染防治立法較為完善的國家,如美國、日本、德國等國家先進(jìn)經(jīng)驗(yàn)的介紹,總結(jié)了值得我國學(xué)習(xí)借鑒之處。第五部分是文章的重點(diǎn)部分。明確了構(gòu)建我國完善的環(huán)境噪聲污染防治法律措施是非常有必要的,并對完善我國環(huán)境噪聲污染防治提出了相應(yīng)的法制對策。闡述了環(huán)境噪聲污染防治應(yīng)遵循的原則。并針對環(huán)境噪聲污染防治立法、執(zhí)法、司法方面出現(xiàn)的問題提出了相應(yīng)的完善建議。
[Abstract]:At present, various environmental pollution problems appear all over the world. Among them, the increasingly serious noise pollution problem has gradually become an important environmental problem that the whole society pays close attention to. The research on noise pollution began in the seventeenth century. After 1950's, noise was recognized as a kind of serious environmental pollution. In recent years, noise pollution, together with air pollution, water pollution and solid waste pollution, has been regarded as the four major pollution hazards in the society, which has brought adverse effects to human development. At present, people are pursuing high quality of material life and spiritual enjoyment, at the same time, the requirement of sound environment is becoming higher and higher. The problem of environmental noise pollution needs to be solved urgently. Based on the background of the sustainable development of national economy and society, this paper draws lessons from the theories of law, environmental protection law, ecological economics, environmental science and so on, and applies the methods of literature analysis, empirical analysis, comparative analysis and so on. Taking the law as the main line, the prevention and control of environmental noise pollution are discussed. The article is divided into five parts: the first part is the introduction part, which mainly summarizes the background of the subject, the current research situation at home and abroad, the purpose and significance of the research, the main contents and methods of the research. The second part mainly introduces some basic problems of environmental noise, defines the concept of environmental noise and environmental noise pollution, and on the basis of defining related concepts, introduces the characteristics and harm of environmental noise pollution. The third part first summarizes the current situation of environmental noise pollution prevention and control legislation in China. This paper introduces the main duties, supervision and management system, relevant legal system and the special prevention and control regulations and legal liability of the people's governments at all levels. At the same time, it puts forward many defects in the prevention and control of environmental noise pollution in our country at the legal level from three aspects: legislation, law enforcement and judicature. In the fourth part, through the introduction of advanced experiences of foreign countries, such as the United States, Japan, Germany and so on, the author summarizes the points that our country can learn from. The fifth part is the key part of the article. It is necessary to construct perfect legal measures of environmental noise pollution prevention and control in China, and the corresponding legal countermeasures are put forward to perfect the prevention and control of environmental noise pollution in China. The principles of environmental noise pollution prevention and control are expounded. Some suggestions are put forward to solve the problems in legislation, law enforcement and judicature of environmental noise pollution prevention and control.
