【摘要】： 黃海是我國四大海域之一,對(duì)我國的經(jīng)濟(jì)和戰(zhàn)略意義十分重大,為沿海社會(huì)經(jīng)濟(jì)的發(fā)展和人民生活的改善作出了巨大的貢獻(xiàn),對(duì)國計(jì)民生有至關(guān)重要的作用。但近年來隨著人口和經(jīng)濟(jì)的快速發(fā)展,我國黃海海域的環(huán)境問題日益突出,環(huán)境質(zhì)量明顯下降,生態(tài)環(huán)境日趨惡化,赤潮等災(zāi)害頻發(fā)。污染、過度捕撈和海洋、海岸工程等人為因素對(duì)海洋生態(tài)系的破壞不斷加劇,再加上一些自然變化,使黃海生態(tài)系統(tǒng)的生態(tài)循環(huán)和可持續(xù)利用面臨著巨大的威脅。因此,關(guān)注黃海,關(guān)注黃海生物資源問題十分緊迫。 本文分為四大部分進(jìn)行論述。 第一部分為我國黃海海域生物資源概況。本部分首先從地理、經(jīng)濟(jì)和人文的視角對(duì)黃海海域進(jìn)行概括性論說,通過論述海洋生物資源的概念、分類和性質(zhì)為下文論及的海洋生物資源保護(hù)制度奠定了自然科學(xué)和社會(huì)科學(xué)基礎(chǔ)。其次本部分介紹了黃海海域生物資源管理面臨的嚴(yán)峻挑戰(zhàn),從污染,過度開發(fā)等角度闡述黃海發(fā)展面臨的窘境。 第二部分為我國黃海海域生物資源管理法制狀況的述評(píng)。首先通過梳理黃海管理的法律體系構(gòu)成和沿黃海三省的立法現(xiàn)狀,進(jìn)而歸納出目前生物資源管理存在的問題,為下文提出保護(hù)黃海生物資源的對(duì)策提供了事實(shí)依據(jù)。 第三部分主要為國外生物資源管理制度的述評(píng)。本部分首先立足黃海的實(shí)際情況,通過介紹《中日漁業(yè)協(xié)定》和《中韓漁業(yè)協(xié)定》,從我國與韓國、日本的黃海海域權(quán)益爭議中分析我國黃海的生物資源利用狀況。其次本部分利用比較分析的方法對(duì)日本瀨戶內(nèi)海、地中海、黑海和北海區(qū)域海洋生物資源管理制度進(jìn)行對(duì)比和分析,將國外海洋生物資源管理制度進(jìn)行分類歸納,借鑒國外管理經(jīng)驗(yàn),期望能夠?yàn)榻鉀Q我國黃海生物資源管理的法律問題提供參考,也為文章的第四部分提供一些啟發(fā)。 第四部分為對(duì)我國黃海生物資源管理法律制度的完善的探討。本部分從加強(qiáng)海洋資源開發(fā)利用的環(huán)境保護(hù)管理、污染控制與防治、海洋生態(tài)保護(hù)、海洋環(huán)境災(zāi)害防治與能力建設(shè)、不斷完善海洋法律體系、公眾參與等五個(gè)方面提出了建議。
[Abstract]:Huang Hai is one of the four major sea areas in China, which is of great economic and strategic significance to our country. It has made a great contribution to the development of the coastal social economy and the improvement of people's life, and has played a vital role in the national economy and the people's livelihood. However, with the rapid development of population and economy in recent years, the environmental problems in China's Huang Hai sea areas have become increasingly prominent, the environmental quality has obviously declined, the ecological environment has been deteriorating day by day, and the red tide and other disasters occur frequently. Pollution, overfishing and marine, coastal engineering and other man-made factors have aggravated the destruction of marine ecosystem, coupled with some natural changes, which make the ecological cycle and sustainable use of Huang Hai ecosystem face a huge threat. Therefore, it is urgent to pay attention to the problem of Huang Hai biological resources. This paper is divided into four parts to discuss. The first part is the overview of biological resources in Huang Hai sea area of China. The first part of this part from the geographical, economic and human perspectives on the Huang Hai sea area for a general discussion, through the discussion of the concept of marine living resources, Classification and nature lay the foundation of natural and social sciences for the conservation system of marine living resources discussed below. Secondly, this part introduces the severe challenges faced by the management of biological resources in the Huang Hai sea area, and expounds the dilemma of the development of Huang Hai from the aspects of pollution, over-exploitation and so on. The second part is a review of the legal system of biological resources management in China's Huang Hai sea area. Firstly, by combing the composition of the legal system of Huang Hai management and the legislative status along the three provinces of Huang Hai, this paper concludes the existing problems in the management of biological resources and provides a factual basis for the following countermeasures to protect the biological resources of Huang Hai. The third part mainly reviews the foreign biological resources management system. Based on the actual situation of Huang Hai, this part analyzes the utilization of biological resources of Huang Hai in China from the disputes between China and South Korea and Japan on the rights and interests of Huang Hai by introducing the "Sino-Japanese Fisheries Agreement" and "Sino-Korean Fisheries Agreement". Secondly, this part uses the method of comparative analysis to compare and analyze the marine living resources management systems in the Seto Sea, Mediterranean Sea, Black Sea and North Sea areas of Japan, and classify and summarize the foreign marine living resources management systems. Using foreign management experience for reference, it is expected to provide reference for solving the legal problems of Huang Hai biological resources management in China, and also provide some inspiration for the fourth part of this paper. The fourth part discusses the perfection of the legal system of Huang Hai biological resources management in China. In this part, suggestions are put forward from five aspects: strengthening environmental protection and management of marine resources development and utilization, pollution control and prevention, marine ecological protection, marine environmental disaster prevention and capacity-building, continuous improvement of marine legal system and public participation.
