【摘要】： 環(huán)境權是環(huán)境法中的核心概念,研究環(huán)境權及其實現(xiàn)途徑有著理論和實踐上的雙重意義。從世界范圍看來,環(huán)境權法律化,并通過司法實踐轉化為公民的實有權利已經(jīng)成為了必然趨勢。但是長期以來,由于種種原因,環(huán)境權在我國存在法律缺位,導致我國的環(huán)境污染現(xiàn)象日益嚴重,在一些地區(qū)環(huán)境問題已成為危害人民健康、制約經(jīng)濟發(fā)展和社會穩(wěn)定的一個重要因素。 環(huán)境權作為一項新型的獨立人權,具有公益性及私益性雙重屬性。要使環(huán)境權從應然權利發(fā)展為法定權利繼而演變?yōu)閷嵢粰嗬?必須從其社會性入手,將環(huán)境公益訴訟和私法救濟兩個層面相結合為環(huán)境權法律化的實現(xiàn)打下基礎。本文在分析環(huán)境權法律化陷入困境原因的基礎上,從環(huán)境保護和維護公民權利的角度,探討了我國實現(xiàn)環(huán)境權法律化的有效途徑。經(jīng)過研究和探討后,本文對構建環(huán)境權法律化的制度框架提出了一些可行性建議,并確立了私法救濟以及公益訴訟在環(huán)境權法律化過程中的主導地位。總之,盡快建構一個全方位、多層次的環(huán)境權法律化制度構架,是走出我國環(huán)境權法律化困境及實現(xiàn)環(huán)境權法律化的關鍵。
[Abstract]:Environmental right is the core concept in environmental law. It is of both theoretical and practical significance to study environmental right and its realization. From the point of view of the world, it has become an inevitable trend to legalize environmental rights and transform them into citizens' real rights through judicial practice. However, for a long time, due to various reasons, there is a lack of laws on environmental rights in our country, which leads to the increasingly serious environmental pollution phenomenon in our country. In some areas, environmental problems have become harmful to the health of the people. An important factor restricting economic development and social stability. As a new type of independent human rights, environmental right has the dual attributes of public welfare and private interest. In order to make the environmental right develop from the legal right to the legal right and then to the real right, we must start with its sociality and lay the foundation for the realization of the legalization of the environmental right by combining the two levels of environmental public interest litigation and private law relief. Based on the analysis of the reasons why the legalization of environmental rights is in difficulty, this paper discusses the effective ways to realize the legalization of environmental rights in China from the point of view of environmental protection and protection of civil rights. After studying and discussing, this paper puts forward some feasible suggestions to construct the system frame of environmental right legalization, and establishes the leading position of private law relief and public interest litigation in the process of environmental right legalization. In a word, it is the key to get out of the dilemma of legalization of environmental rights and to realize the legalization of environmental rights by constructing a comprehensive and multi-level legal system of environmental rights as soon as possible.
