【摘要】：環(huán)境糾紛是時(shí)代發(fā)展的產(chǎn)物。隨著經(jīng)濟(jì)的迅猛發(fā)展,我國(guó)已進(jìn)入環(huán)境糾紛高發(fā)階段。有效解決環(huán)境糾紛是目前關(guān)注度較高的一個(gè)話題。訴訟作為解決環(huán)境民事糾紛的主要手段,既扮演著不可替代的重要角色,同時(shí)其在現(xiàn)實(shí)生活中解決環(huán)境民事糾紛的運(yùn)作情況又暴露出一定的不適性。伴隨著環(huán)境民事糾紛量與質(zhì)對(duì)訴訟的雙重挑戰(zhàn),人們敏銳地發(fā)現(xiàn)訴訟對(duì)現(xiàn)有環(huán)境民事糾紛心有余而力不足,增強(qiáng)了人們對(duì)解決糾紛另辟蹊徑的決心。尤其是在構(gòu)建和諧社會(huì)理念提出后,訴訟對(duì)環(huán)境民事糾紛的解決更是受到和諧社會(huì)“和”思想的強(qiáng)烈沖擊,為訴訟之外其他非訴訟解決方式的研究預(yù)留了發(fā)展的空間。社會(huì)對(duì)人們選擇權(quán)的尊重與人們對(duì)糾紛解決理性追求的碰撞使環(huán)境民事糾紛非訴訟解決方式有蓬勃發(fā)展之勢(shì)�？梢哉f,內(nèi)因和外因的結(jié)合是環(huán)境民事糾紛非訴訟解決方式茁壯成長(zhǎng)的催化劑,理論基礎(chǔ)和實(shí)踐結(jié)果都無不證明環(huán)境民事糾紛非訴訟解決方式的正當(dāng)性。 環(huán)境民事糾紛非訴訟解決方式有廣闊的運(yùn)用前景,不僅源于訴訟固有缺陷在環(huán)境民事糾紛中的延伸與擴(kuò)大,更重要的是其自身優(yōu)勢(shì)與和諧思想的融合。環(huán)境民事糾紛非訴訟解決方式的產(chǎn)生與發(fā)展并不是以取代訴訟為目的,而是旨在補(bǔ)充訴訟制度的不足,建立良性互動(dòng)的多元化糾紛解決機(jī)制。本文也正是在這樣的思路指導(dǎo)下完成的。把握好環(huán)境民事糾紛的特殊性,研究環(huán)境民事糾紛非訴訟解決方式,擴(kuò)大環(huán)境民事糾紛解決方式的多樣性,提升整個(gè)環(huán)境民事糾紛解決機(jī)制的解紛能力,是環(huán)境民事糾紛解決的趨勢(shì),也是化解社會(huì)不和諧因素的合理舉措。但是,環(huán)境糾紛非訴訟解決方式發(fā)展的可行性并不能消除其實(shí)際運(yùn)行的障礙,人民調(diào)解、行政處理等非訴訟解決方式表現(xiàn)出的種種弊端使完善環(huán)境糾紛非訴訟解決方式刻不容緩。所幸的是國(guó)外對(duì)環(huán)境民事糾紛非訴訟解決方式的研究較為成熟,為我國(guó)完善其制度開拓了一條借鑒之路。 本文共分為四個(gè)部分。第一部分,對(duì)環(huán)境民事糾紛與非訴訟糾紛解決方式進(jìn)行充分闡述,為全篇論文作了鋪墊。此部分闡述了環(huán)境民事糾紛和非訴訟糾紛解決方式的概念、特征。第二部分,環(huán)境民事糾紛非訴訟解決方式概述。論述了環(huán)境民事糾紛非訴訟解決方式的產(chǎn)生、主要方式,環(huán)境民事糾紛非訴訟解決方式的理論基礎(chǔ)和必要性。第三部分,環(huán)境民事糾紛非訴訟解決方式的現(xiàn)狀和缺陷。從國(guó)際上環(huán)境糾紛非訴訟解決方式發(fā)展比較好的美國(guó)和日本入手進(jìn)行域外考查,發(fā)現(xiàn)我國(guó)在這方面的缺陷以及借鑒他國(guó)的先進(jìn)經(jīng)驗(yàn)。第四部分,環(huán)境民事糾紛非訴訟解決方式的完善。通過立法、實(shí)踐中對(duì)各種非訴訟糾紛解決方式的具體設(shè)計(jì)以及相關(guān)問題的完善,期待環(huán)境民事糾紛非訴訟解決方式成為有機(jī)統(tǒng)一、高效運(yùn)作的解紛體系。
[Abstract]:Environmental disputes are the product of the development of the times. With the rapid development of economy, China has entered the stage of high incidence of environmental disputes. Effective resolution of environmental disputes is a topic of high concern at present. Litigation, as the main means to solve environmental civil disputes, plays an irreplaceable important role, and at the same time, the operation of solving environmental civil disputes in real life reveals some discomfort. With the double challenge of environmental civil dispute quantity and quality, people have found that litigation has more than enough strength to the existing environmental civil dispute, which has strengthened people's determination to find a new way to solve the dispute. Especially after the idea of constructing a harmonious society is put forward, the solution of environmental civil disputes is strongly impacted by the idea of harmonious society "and", which reserves the space for the development of other non-litigation solutions besides litigation. The collision between social respect for people's right to choose and rational pursuit of dispute resolution makes non-litigation solutions to environmental civil disputes flourish. It can be said that the combination of internal and external causes is the catalyst for the development of non-litigation solutions to environmental civil disputes. The theoretical basis and practical results all prove the legitimacy of non-litigation solutions to environmental civil disputes. The non-litigation solution of environmental civil disputes has a broad application prospect, not only from the extension and expansion of inherent defects in environmental civil disputes, but also from the integration of its own advantages and harmonious thoughts. The emergence and development of non-litigation settlement of environmental civil disputes is not to replace litigation, but to supplement the deficiencies of litigation system and to establish a diversified dispute resolution mechanism with benign interaction. This article is also completed under the guidance of such a train of thought. To grasp the particularity of environmental civil disputes, to study non-litigation solutions of environmental civil disputes, to expand the diversity of environmental civil dispute resolution, and to enhance the ability of the whole environmental civil dispute resolution mechanism. It is the trend of environmental civil dispute resolution and a reasonable measure to resolve social disharmony. However, the feasibility of developing non-litigation solutions to environmental disputes cannot eliminate the obstacles to their actual operation. The malpractices of non-litigation solutions such as administrative treatment make it urgent to perfect non-litigation solutions to environmental disputes. Fortunately, the foreign research on non-litigation settlement of environmental civil disputes is more mature, which opens a way for our country to perfect its system. This paper is divided into four parts. In the first part, the environmental civil dispute and non-litigation dispute settlement methods are fully elaborated, which pave the way for the whole paper. This part expounds the concept and characteristics of environmental civil dispute and non-litigation dispute settlement. The second part, the environmental civil dispute non-litigation settlement. This paper discusses the emergence and main ways of non-litigation settlement of environmental civil disputes, and the theoretical basis and necessity of non-litigation settlement of environmental civil disputes. The third part, the environmental civil dispute non-litigation settlement of the status quo and defects. From the perspective of the United States and Japan, which have developed well in the non-litigation settlement of environmental disputes in the world, it is found that our country has defects in this respect and draws lessons from the advanced experience of other countries. The fourth part, the improvement of non-litigation settlement of environmental civil disputes. Through legislation, the specific design of various non-litigation dispute resolution methods and the improvement of related problems in practice, it is expected that the non-litigation settlement of environmental civil disputes will become an organic unified and highly efficient dispute resolution system.
