【摘要】： 隨著社會(huì)政治經(jīng)濟(jì)的發(fā)展和現(xiàn)代生物技術(shù)的應(yīng)用,生物安全問(wèn)題層出不窮:轉(zhuǎn)基因生物和轉(zhuǎn)基因食品的危害、生物入侵、傳染性疾病疫情時(shí)有發(fā)生、生物恐怖主義威脅無(wú)處不在,等等。生物安全己成為非傳統(tǒng)安全領(lǐng)域中的突出問(wèn)題,嚴(yán)重威脅人類(lèi)健康、社會(huì)發(fā)展和國(guó)家安全。各國(guó)和國(guó)際社會(huì)都積極采取措施,制定生物安全政策,加強(qiáng)生物安全立法,確保國(guó)家及國(guó)際生物安全。 社會(huì)需要法律,社會(huì)發(fā)展需要發(fā)展的法律,正是法律發(fā)展才使社會(huì)發(fā)展有可能健康、有序、富有生機(jī)地進(jìn)行。生物安全問(wèn)題的層出不窮必然會(huì)對(duì)法律的發(fā)展產(chǎn)生影響,作為規(guī)范人類(lèi)行為的一種手段的法律,也會(huì)對(duì)生物安全問(wèn)題做出反映,這一反映突出表現(xiàn)為國(guó)際社會(huì)和有關(guān)國(guó)家的生物安全立法。通過(guò)法律規(guī)制生物安全問(wèn)題,使生物安全受到法律的合理規(guī)制,一方面,使人們普遍關(guān)注生物安全問(wèn)題,保護(hù)人類(lèi)的自身安全,維護(hù)正常的倫理道德和社會(huì)秩序并維系世代間的公平,保護(hù)生物多樣性和人類(lèi)的可持續(xù)發(fā)展;另一方面,為法學(xué)研究開(kāi)辟新的研究領(lǐng)域,以填補(bǔ)在法學(xué)領(lǐng)域內(nèi)的學(xué)科建設(shè)和理論研究的空白。 本文旨在以國(guó)際生物安全法律規(guī)制之現(xiàn)狀,來(lái)分析我國(guó)生物安全法律規(guī)制的不足及提出改善意見(jiàn)。論文通過(guò)對(duì)生物安全產(chǎn)生的國(guó)際、國(guó)內(nèi)背景和生物安全涵義的發(fā)展,給出了比較全面的生物安全的涵義;對(duì)生物安全問(wèn)題的表象作出分析概括,并指出法律對(duì)此的因應(yīng)和不足,從而闡述生物安全的法律意義;從國(guó)際間生物安全的分歧與合作及我國(guó)在其中的利益主張和參加的合作范例,國(guó)際生物安全法的基本原則和基本制度,來(lái)分析論述了當(dāng)前國(guó)際生物安全法律規(guī)制的現(xiàn)狀,分析了我國(guó)的生物安全的現(xiàn)實(shí),我國(guó)生物安全法律政策的現(xiàn)狀,存在的不足,比如,立法級(jí)別比較低、缺乏健全的法規(guī)體系等。完善的建議,如,借鑒國(guó)外生物安全立法的經(jīng)驗(yàn)、開(kāi)展國(guó)際合作等。
[Abstract]:With the development of social politics and economy and the application of modern biotechnology, biosafety problems emerge in endlessly: the harm of transgenic organisms and genetically modified foods, biological invasion, infectious diseases epidemic situation has occurred from time to time. The threat of bioterrorism is everywhere, and so on. Biosafety has become a prominent problem in the field of non-traditional security, which is a serious threat to human health, social development and national security. All countries and the international community have taken active measures to formulate biosafety policies, strengthen biosafety legislation and ensure national and international biosafety. The society needs the law, the social development needs the law of development, it is the law development that makes the social development possible healthy, orderly and vigorous. The endless emergence of biosafety problems will inevitably have an impact on the development of the law. As a means of regulating human behavior, the law will also respond to the biosafety problem. This reflects prominently the biosafety legislation of the international community and the countries concerned. Through legal regulation of biosafety, biosafety is regulated reasonably by law. On the one hand, it makes people pay more attention to biosafety and protect human's own safety. Maintaining normal ethical and social order and maintaining intergenerational equity, protecting biodiversity and sustainable human development; on the other hand, opening up new fields of research for legal research, In order to fill in the field of law discipline construction and theoretical research gaps. The purpose of this paper is to analyze the deficiency of the legal regulation of biosafety in our country and to put forward some suggestions for improvement with the present situation of international legal regulation on biosafety. Through the development of the international and domestic background and the meaning of biosafety, the thesis gives a more comprehensive meaning of biosafety, analyzes and generalizes the appearance of biosafety, and points out the countermeasures and deficiencies of the law. Thus, the legal significance of biosafety, the basic principles and systems of international biosafety law, and the international differences and cooperation in biosafety, as well as the cooperation examples of our country's interests and participation in it, are expounded. The present situation of international biosafety legal regulation, the reality of biosafety in our country, the present situation of biosafety law and policy in our country, the shortcomings, for example, the low level of legislation, are analyzed and discussed. Lack of a sound legal system, etc. Perfect suggestion, for example, draw lessons from the experience of foreign biosafety legislation, carry out international cooperation, etc.
